It examines the availability of health reimbursement arrangements (HRAs) and health savings account (HSA)-eligible plans (consumer-driven health plans, or CDHPs), as well as employer and individual contribution behavior. According to the 2012 CEHCS, 11.6 million adults ages 21-64 (or 7 percent of the population) were enrolled in a plan with an HRA or HSA. An additional 7 million reported that they were covered by an HSA-eligible plan but had not opened such an account. Thus, overall, 18.6 million adults ages 21-64 with private insurance, representing 15.4 percent of that market, were either in a CDHP or an HSA-eligible plan but had not opened the account that would be used to fund covered expenses. When their children were counted, 25.2 million individuals with private insurance, representing 14.6 percent of the market, were either in a CDHP or an HSA-eligible plan. Seven out of 10 workers (69 percent) with an HRA or HSA reported that their employers contributed to the account in 2012. The percentage of workers with an HRA or HSA plan whose employers contributed to the account has been steadily increasing since 2009. Workers with employee-only coverage did not increase their own contributions in 2012, but those with family coverage did. The report found a correlation between health engagement and individual contributions to an HSA. Those defined as being engaged in their health reported that they did at least one of the following: checked whether their health plan would cover their care or medication; checked the price of a doctor's visit, medication, or other health care service before receiving care; checked the quality rating of a doctor or hospital before receiving care; talked to their doctor about prescription options, costs, other treatment options and costs; used an online cost tracking tool provided by their health plan to manage health expenses; developed a budget to manage health care expenses; asked for a generic drug instead of a brand name drug; or asked their doctor to recommend a less costly prescription drug. It was found that individuals with some engagement with the health care system contributed higher amounts to their HSA than those with no engagement. In 2012, 48 percent of those with no engagement with the health care system contributed $1,500 or more, whereas 55 percent of those with some engagement with the health care system contributed $1,500 or more. Thus, overall, 15.8 million adults ages 21-64 with private insurance, representing 13.1 percent of that market, were either in a CDHP or an HSA-eligible plan but had not opened the account. When their children are counted, about 21 million individuals with private insurance, representing about 12 percent of the market, were either in a CDHP or an HSA-eligible plan. Two-thirds of workers with an HRA or HSA reported that their employer contributed to the account in 2011. Among workers with an employer contribution, those with employee-only coverage saw their annual employer contributions increase between 2006 and 2008, but fall in 2009 and 2011. Between 2006 and 2008, the percentage reporting that their employer contributed $1,000 or more to the account increased from 26 percent to 37 percent. It fell to 32 percent in 2009 and to 24 percent in 2011. The percentage of workers with an employer contribution of $200-$499 increased from 14 percent to 22 percent between 2009 and 2011. Among workers with family coverage, employer contribution levels were unchanged between 2010 and 2011. The percentage reporting a contribution of $1,000 or more was 64 percent in 2011. Individuals' contributions to HSA plans have increased. Between 2006 and 2011, the percentage of individuals with employee-only coverage contributing nothing to an HSA decreased from 28 percent to 11 percent. In contrast, the percentage contributing $1,500 or more increased from 21 percent in 2006 to 44 percent in 2011. Among persons with family coverage, contribution levels were unchanged in 2011, and, in contrast to individual coverage, there are no observed long-term trends toward higher contributions. The percentage not making any contributions was unchanged at 10 percent in 2011. The percentage contributing less than $500 was 9 percent, while the percentage contributing $1,500 or more was 54 percent. A greater percentage of individuals with family coverage than with individual coverage contribute $1,500 or more, which is expected because deductibles are higher for family coverage. Among workers with an employer contribution, those with employee-only coverage saw their annual employer contributions increase between 2006 and 2008, but fall in 2009 and 2010. Between 2006 and 2008, the percentage reporting that their employer contributed $1,000 or more to the account increased from 26 percent to 37 percent. It fell to 32 percent in 2009 and to 28 percent in 2010. The percentage of workers with an employer contribution of $200-$499 increased from 14 percent to 17 percent between 2009 and 2010, although the increase was not statistically significant. Among workers with family coverage, employer contribution levels decreased as well in 2010. The percentage reporting a contribution of $500-$749 increased from 6 percent to 12 percent between 2009 and 2010, while the percentage reporting a contribution of $1,000 or more decreased from 73 percent to 61 percent. However, a majority of workers with family coverage continued to receive a contribution of $1,000 or more. Individuals' contributions to HSA plans have increased. Between 2006 and 2009, the percentage of individuals with employee-only coverage contributing nothing to an HSA decreased from 28 percent to 12 percent. It increased to 15 percent in 2010 but the change was not statistically significant. In contrast, the percentage contributing between $1,000 and $1,499 increased from 12 percent in 2009 to 18 percent in 2010, while the percentage contributing $1,500 or more remained at 37 percent. Among persons with family coverage, the percentage not making any contributions was unchanged at 12 percent in 2010. The percentage contributing less than $500 was 8 percent, while the percentage contributing $1,500 or more was 50 percent. Individuals with family coverage are expected to contribute more than individuals with employee-only coverage because deductibles are higher for family coverage. Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel.
