Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Elements of American Jurisprudence Jurisprudence, as the word is used in the title of this book, denotes the science of which law, as such, is the subject-matter; the science which deals, not with the commands and prohibitions whereof the law consists, but with the law itself, its nature, its origin, its history, its divisions, its forms, its interpretation, and the methods of its application to practical affairs. Of law in general, considered as an essential feature of political society and abstracted from all definite systems of law, there is a universal science known as General Jurisprudence; and of every system of law, differing as each does from every other in some of its exterior characteristics, there is a special science, - the Particular Jurisprudence of the State in which that law prevails. Thus American Jurisprudence is a special science, treating of the laws of the United States and of the States of which the American Union is composed. Manifestly some knowledge of this science is important to every educated citizen who aspires to the intelligent discharge of his political duties; a more intimate acquaintance with it is indispensable to the lawyer and the judge who participate in the interpretation and administration of the law; while for the jurist and the legislator the mastery over it must be still broader and more profound. In the present work it has been the purpose of the author to assist the various grades of students in their preparation for these different positions in political life. Book excerpt: This casebook is ideal for any introduction to law or legal method course. It is designed to develop analytic, interpretive, and advocacy skills that will be helpful to students across the range of substantive courses, while also encouraging students to think critically about the judicial process and the role of judges in a democracy. The second edition of Elements of Law significantly reworks and updates the first edition, which was published in 1994, while preserving the essential features and many of the principal cases from that edition. This edition is more compact than its predecessor because the lengthy materials on jurisprudence have been eliminated. Thus, half of the book is devoted to the common law and half to statutory interpretation.

Book excerpt: This unique study offers a comprehensive analysis of American jurisprudence from its emergence in the later stages of the nineteenth century through to the present day. The author argues that it is a mistake to view American jurisprudence as a collection of movements and schools which have emerged in opposition to each other. By offering a highly original analysis of legal formalism, legal realism, policy science, process jurisprudence, law and economics, and critical legal studies, he demonstrates that American jurisprudence has evolved as a collection of themes which reflects broader American intellectual and cultural concerns.

Book excerpt: Georgia Legal Research is the first book of its kind devoted to the resources and strategies needed to research Georgia state law. Taking a process-oriented approach, the book explains research in Georgia cases, statutes, legislative history, constitutional law, and administrative law and legal ethics research. Additional chapters describe the research process, secondary sources and practical guides, online research and citators. Appendices include legal citation rules, bibliography of legal research texts, and a list of Georgia practice materials. Georgia Legal Research was designed specifically for teaching legal research to first-year law students. Others who will find it helpful include practitioners, paralegals, librarians, college students, and even laypeople. It is clearly written, making even complex ideas accessible. Outlines of the research process and short excerpts from Georgia resources make the book easy to use. Web addresses point researchers to the many sources for finding free Georgia legal material online. Concise explanations of resources needed for researching federal law and the law of other states are provided throughout. Thus, Georgia Legal Research can be used as a stand-alone text or in conjunction with a research text concentrating on federal law. This book is part of the Legal Research Series, edited by Suzanne E. Rowe, Director of Legal Research and Writing, University of Oregon School of Law.

Available in PDF, EPUB and Kindle. Book excerpt: This anthology presents, for the first time, full texts of the twenty most important works of American legal thought since 1890. Drawing on a course the editors teach at Harvard Law School, the book traces the rise and evolution of a distinctly American form of legal reasoning. These are the articles that have made these authors--from Oliver Wendell Holmes, Jr., to Ronald Coase, from Ronald Dworkin to Catherine MacKinnon--among the most recognized names in American legal history. These authors proposed answers to the classic question: "What does it mean to think like a lawyer--an American lawyer?" Their answers differed, but taken together they form a powerful brief for the existence of a distinct and powerful style of reasoning--and of rulership. The legal mind is as often critical as constructive, however, and these texts form a canon of critical thinking, a toolbox for resisting and unravelling the arguments of the best legal minds. Each article is preceded by a short introduction highlighting the article's main ideas and situating it in the context of its author's broader intellectual projects, the scholarly debates of his or her time, and the reception the article received. Law students and their teachers will benefit from seeing these classic writings, in full, in the context of their original development. For lawyers, the collection will take them back to their best days in law school. All readers will be struck by the richness, the subtlety, and the sophistication with which so many of what have become the clichés of everyday legal argument were originally formulated.

Available in PDF, EPUB and Kindle. Book excerpt: American legal history is traditionally viewed as a succession of discrete schools of thought or landmark court decisions, not as the work of individuals. Such an approach, however, hardly does justice to the lives of two of the foremost teachers and theorists of American jurisprudence. In Roscoe Pound and Karl Llwellyn: Searcbing for an American Jurisprudence, N. E. H. Hull reconstructs the historical, cultural, and intellectual context of the work of Pound and Llewellyn, bringing to light their private and public relationship as well as the diverse sources - from psychology to plant ecology to Icelandic sagas - they separately drew upon in making their contributions to the American legal tradition.
