Book excerpt: Most Americans consider electricity essential to their lives, but the historic disparity of its distribution and use challenges notions of a democratic lifestyle, economy, and culture. By the beginning of the twentieth century, substations, wires, towers, and poles had followed migrants westward as the industrial era?s most prominent symbols of progress and power. When private companies controlled power production, electrical transmission, and distribution without regulation, they argued that it was not ?economically feasible? for many ethnic and rural communities to access ?the grid.? Yet, government agents continued to advocate electrical living through federal programs that reached into and across farming communities and American Indian reservations to homogenize and assimilate them through urban technologies. In the end, however, rural electrification was a locally directed process, subject to local and regional issues, concerns, and parameters. ø Electrifying the Rural American West provides a social and cultural history of rural electrification in the West. Using three case studies in Arizona, Leah S. Glaser details how, when examined from the local level, the process of electrification illustrates the impact of technology on places, economies, and lifestyles in the diverse communities and landscapes of the American West. As today?s policy-makers advocate building more power lines as a tool to bring democracy to faraway places and ?smart grids? to deliver renewable energy, they would do well to review the historical relationship of Americans with electronic power production, distribution, and regulation.

Book excerpt: Meet Michael Skelly, the man boldly harnessing wind energy that could power America’s future and break its fossil fuel dependence in this “essential, compelling look into the future of the nation’s power grid” (Bryan Burrough, author of The Big Rich). The United States is in the midst of an energy transition. We have fallen out of love with dirty fossil fuels and want to embrace renewable energy sources like wind and solar. A transition from a North American power grid that is powered mostly by fossil fuels to one that is predominantly clean is feasible, but it would require a massive building spree—wind turbines, solar panels, wires, and billions of dollars would be needed. Enter Michael Skelly, an infrastructure builder who began working on wind energy in 2000 when many considered the industry a joke. Eight years later, Skelly helped build the second largest wind power company in the United States—and sold it for $2 billion. Wind energy was no longer funny—it was well on its way to powering more than 6% of electricity in the United States. Award-winning journalist, Russel Gold tells Skelly’s story, which in many ways is the story of our nation’s evolving relationship with renewable energy. Gold illustrates how Skelly’s company, Clean Line Energy, conceived the idea for a new power grid that would allow sunlight where abundant to light up homes in the cloudy states thousands of miles away, and take wind from the Great Plains to keep air conditioners running in Atlanta. Thrilling, provocative, and important, Superpower is a fascinating look at America’s future.

Book excerpt: In September, 1999, Texas enacted its groundbreaking retail electric deregulation law. Although not immediate in effect, the legislation eventually ushered in some of the biggest changes ever for Texas electricity consumers. No longer would giant, vertical-integrated utilities maintain their monopoly grip on home electricity service. No longer would Austin political appointees determine directly the price of air conditioning and lighting in all parts of Texas. In commemoration of the 20th anniversary of the law, the Texas Coalition for Affordable Power has released an updated version if its signature report, Electric Deregulation in Texas: A Market Chronicle. The book, organized chronologically in a year-by-year fashion, describes key deregulation-related events, beginning with those years prior to the adoption of the 1999 law and up through 2019. It includes more than 20 sequential chapters, each focusing on individual years. The report updates an earlier version first released in 2009 by TCAP for the law's 10-year anniversary.

Book excerpt: From February 14-19, 2021, winter storm Uri blanketed Texas with extreme cold. Tragically, the severe temperatures overwhelmed the state's power system. Texas' power grid ended up more than 20 Gigawatts short of the electricity Texans needed - more power than all of California produces on an average day. Over two-hundred lives were lost and an estimated $295 billion in damage resulted. Yet many had long regarded Texas' electric power system, and its regulation, as a model for others. What happened? That question is the focus of this article. This article first provides an overview of the severe power outages in February 2021 and the regulation of Texas' electric power system, explaining why Texas is on the forefront of challenges that will grow more prominent as the world transitions to cleaner energy. Next, it discusses competing electric power business models and their regulation, including why many had long viewed Texas as a model of wise electricity regulation, and why the problems revealed by winter storm Uri will only grow more pressing for not just Texas but the entire world as it transitions to more reliance on electricity and a power grid supported by natural gas and renewables. It concludes by discussing Texas' path forward and the broader lessons of this crisis for business lawyers and others. The tremendous economic losses of this episode attest to the importance of business lawyers having a basic understanding of their clients' energy dependencies, the risks that significant power problems could present to their businesses, and the ability to advise them as they seek to mitigate such vulnerabilities.
