Available in PDF, EPUB and Kindle. Book excerpt: A new edition of the preeminent work on the permanent establishment (PE) is a major event in tax law scholarship. Taking into account changes in judicial and administrative practice as well as the Organisation for Economic Co-operation and Development’s (OECD’s) and the United Nation’s (UN’s) work in the three decades since the first edition, the present study brings the analysis up to date with the current internationally accepted interpretation of PE. The analysis is based on more than 720 cases from more than 20 countries, in addition to the OECD and UN model treaties and more than 630 books, articles, and official documents. The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept. The book provides many synopses of court decisions and administrative rulings upon which the analysis is based. In addition to cases previously published in law reports and other publications, a number of unpublished decisions are included. A key word index makes it easy to find what is needed in any particular matter. The PE principle, in one version or another, is used in several thousand tax treaties in force today. This updated comprehensive study reveals the obligations imposed through the use of PE in tax treaties and will continue to be of immeasurable value to tax practitioners and scholars worldwide. In addition, the discussion of whether the notion of PE is an appropriate criterion for taxing jurisdiction in international fiscal law today provides authoritative and insightful food for thought.

Book excerpt: Fray Bernardino de Sahagún-INAH Award in Mexico for Best Research Work in Anthropology Gabriela Zamorano Villarreal examines the political dimension of indigenous media production and distribution as a means by which indigenous organizations articulate new claims on national politics in Bolivia, a country experiencing one of the most notable cases of social mobilization and indigenous-based constitutional transformation in contemporary Latin America. Based on fieldwork in Bolivia from 2005 to 2007, Zamorano Villarreal details how grassroots indigenous media production has been instrumental to indigenous political demands for a Constituent Assembly and for implementing the new constitution within Evo Morales's controversial administration. On a day-to-day basis, Zamorano Villarreal witnessed the myriad processes by which Bolivia's indigenous peoples craft images of political struggle and enfranchisement to produce films about their role in Bolivian society. Indigenous Media and Political Imaginaries in Contemporary Bolivia contributes a wholly new and original perspective on indigenous media worlds in Bolivia: the collaborative and decolonizing authorship of indigenous media against the neoliberal multicultural state, and its key role in reimagining national politics. Zamorano Villarreal unravels the negotiations among indigenous media makers about how to fairly depict a gender, territorial, or justice conflict in their films to promote grassroots understanding of indigenous peoples in Bolivia's multicultural society.

Book excerpt: Bolivia witnessed a left-indigenous insurrectionary cycle between 2000 and 2005 that overthrew two neoliberal presidents and laid the foundation for Evo Morales’ successful bid to become the country’s first indigenous head of state in 2006. Building on the theoretical traditions of revolutionary Marxism and indigenous liberation, this book provides an analytical framework for understanding the fine-grained sociological and political nuances of twenty-first century Bolivian class-struggle, state-repression, and indigenous resistance, as well the deeply historical roots of today’s oppositional traditions. Drawing on extensive ethnographic fieldwork, including more than 80 in-depth interviews with social-movement and trade-union activists, Red October is a ground-breaking intervention in the study of contemporary Bolivia and the wider Latin American turn to the left over the last decade.

Book excerpt: This groundbreaking text explores the dramatic evolution in Latin American social movements over the past fifteen years. Leading scholars examine a variety of cases that highlight significant shifts in the region. First is the breakdown of the Washington Consensus and the global economic crisis since 2008, accompanied by the rise of new paradigms such as buen vivir (living well). Second are transformations in internal movement dynamics and strategies, especially the growth of horizontalism (horizontalidad), which emphasizes non-hierarchical relations within society rather than directly tackling state power. Third are new dynamics of resistance and repression as movements interact with the “pink tide” rise of left-of-center governments in the region. Exploring outcomes and future directions, the contributors consider the variations between movements arising from immediate circumstances (such as Oaxaca’s 2006 uprising and Brazil’s 2013 bus fare protests) and longer-lasting movements (Vía Campesina, Brazil’s MST, and Mexico’s Zapatistas). Assessing both the continuities in social movement dynamics and important new tendencies, this book will be essential reading for all students of Latin American politics and society.
