En las ediciones anteriores se han comentado las Leyes del Suelo desde el año 1956 hasta el presente. La nueva edición estudia fundamentalmente la Ley 8/07, de 28 de mayo (entiéndase que las referencias a la Ley 8/2007, lo son igualmente al RDLeg. 2/2008, de 20 de junio, por el que se aprueba el Texto Refundido de la Ley de Suelo). Se sigue para ello el mismo esquema de las ediciones anteriores, para lo cual se estudia el concepto de propiedad del suelo de la nueva Ley. Esta concepción nueva supone la privación al propietario de una serie de facultades, como es el derecho a urbanizar y se llega así a una nacionalización arbitraria del suelo. Pocas novedades contiene la Ley en cuanto a la expropiación forzosa, puesto que el objetivo fundamental de esta Ley es el sistema de valoraciones. El sistema de valoraciones del suelo, regulado en al Ley 8/07, es inconstitucional y arbitrario. La Ley pretende aplicar en un sistema constitucional de economía de mercado una excepción para la valoración del suelo con criterios irracionales. Para ello redefine el contenido del derecho a edificar que por medio de esta Ley se nacionaliza, así como el derecho a urbanizar. Sobre esta base se establece un sistema de valoraciones que se olvida del destino urbanístico del suelo y se basa en unas situaciones que olvidan las plusvalías derivadas de la clasificación. La prohibición de valorar plusvalías, la eliminación del método de comparación y la valoración por la renta agraria son instrumentos que se utilizan para esta valoración arbitraria que la Ley trata de implantar. Esta edición se refiere también al momento temporal de la valoración, al régimen transitorio y a la legislación aplicable. Creemos que este régimen de valoraciones va a ser de difícil aplicación, y además producirá una grave inseguridad jurídica.

Así, son objeto de análisis, entre otras, cuestiones como la clasificación del suelo, inevitablemente ligada al concepto de función social, el ius aedificandi y su posible inherencia al contenido del derecho de propiedad del suelo, la valoración del suelo, la posición del propietario ante la obra urbanizadora, la configuración y articulación de los mecanismos de participación de la comunidad en las plusvalías generadas por la acción urbanística de los entes públicos, o la expropiación por incumplimiento de la función social de la propiedad.

Book excerpt: Payments for Environmental Services (PES) are being considered worldwide with great interest and expectation. Proposals to create agreements in which beneficiaries of environmental services pay landowners directly for the provision or protection of these services are innovative and promising. But what real PES experiences are actually out there? This work assesses a range of PES or PES-type experiences in one country, Bolivia, in the fields of carbon sequestration, protection of watershed services, biodiversity and aesthetic landscape values. The report concludes that while none of the generally young initiatives adhere fully to the principle of PES as developed in the theoretical literature, many experiment with some of the relevant PES mechanisms. Protection of watersheds and landscape values are the most common types, though the implementing intermediaries often have underlying biodiversity-protection goals. Main obstacles to PES implementation include ideological resistance against the PES concept, the difficulty of building trust between buyers and sellers, and limited willingness to pay on behalf of service users. During their relatively short lifetime, basically all initiatives had been successful in making service sellers (PES recipients) better off in economic terms, while the effectiveness in achieving environmental objectives and securing positive social impacts so far remained more variable. In some cases, redesigning these initiatives to bring them closer to the full PES principles could also enable them to more effectively achieve positive environmental and livelihood outcomes.

Elites have, instead, begun with a new «military alchemy», treating the whole Planet as weapon of mass destruction. Hence, the «Planetary Movement for Mother Earth».
