En primer término, una corriente liberal, antiperfeccionista, inspirada en la teoría del mercado de ideas, centrada en el emisor de información, que vincula fuertemente libertad de expresión y derecho de propiedad, con una marcada desconfianza hacia el Estado. Asimismo, existe otra teoría, del debate público robusto, que valora especialmente el derecho de la sociedad a recibir información plural, y que asigna a la legislación el deber de garantizar la diversidad de voces y combatir los monopolios mediáticos. Owen Fiss, por caso, es la voz más representativa de esta posición. Por último, está presente una postura extrema, perfeccionista, denominada por algunos autores "nuevo constitucionalismo", inspirada en una concepción rousseoniana de democracia, en donde el propio Estado es quien define los alcances del discurso público. Una vez presentado y analizado este complejo universo jurídico -para el cual se recorren las constituciones de diferentes países latinoamericanos, tratados y fallos internacionales-, el autor trata de demostrar cuál de esas tres corrientes ideológicas es la más propicia para la expansión de la autonomía individual y el enriquecimiento del debate colectivo en las modernas sociedades democráticas, impactadas por las nuevas Tecnologías de la Información y la Comunicación.
