Book excerpt: A través de la Ley Orgánica 1/2015 el legislador español decidió introducir en un nuevo Título XIII bis del Código Penal los denominados delitos de financiación ilegal de los partidos políticos a través de los artículos 304 bis y 304 ter. Esta reforma legislativa, que en un principio parecía suponer un avance imprescindible en nuestro país a la hora de combatir el fenómeno de la corrupción política, fue, sin embargo, severamente criticada por parte de la doctrina especializada, quien puso de manifiesto la inadecuada tipificación penal que se había realizado en este ámbito. Así, la presente monografía aborda precisamente la cuestión de la actual regulación existente en materia de financiación delictiva de los partidos políticos, con objeto de determinar si la misma es adecuada o no. Para ello, se lleva a cabo un completo y riguroso análisis político-criminal y dogmático, examinándose muy diversos aspectos. Se analizan, como cuestiones previas, cuáles son las transcendentales funciones que la Constitución española atribuye a los partidos políticos y cuáles son sus posibles vías de financiación. Para, posteriormente, llevar a cabo un completo análisis jurídico de los actuales tipos penales, examinando todos aquellos elementos que resultan más relevantes en esta materia en base a la Teoría Jurídica del Delito. Y en base a ello, se ponen de manifiesto, no sólo los importantes defectos formales de los que adolecen los preceptos analizados, sino también el hecho de las importantes lagunas en la intervención penal que en éstos se originan, dadas las limitadas conductas que el legislador español ha decidido castigar en esta materia. Por ello, confrontando la regulación penal española con la existente en países cercanos al nuestro, como son Alemania, Italia, Francia y Reino Unido, se llega proponer, al final de esta obra, una concreta propuesta de mejora que evite que en un futuro se produzcan intolerables lagunas de punibilidad, puesto que éstas resultan completamente

También se han desarrollado los escándalos de corrupción más importantes de las últimas décadas estableciendo su íntima relación con las conductas de financiación ilegal y, por último, se ha elaborado un estudio de las distintas propuestas y posiciones doctrinales de distintos autores acerca de la tipificación autónoma de estos delitos.

Liars are saying that COVID-19 is a hoax. They are claiming that vaccines cause autism. They are lying about public officials and about people who aspire to high office. They are lying about their friends and neighbors. They are trying to sell products on the basis of untruths. Unfriendly governments, including Russia, are circulating lies in order to destabilize other nations, including the United Kingdom and the United States. In the face of those problems, the renowned legal scholar Cass Sunstein probes the fundamental question of how we can deter lies while also protecting freedom of speech. To be sure, we cannot eliminate lying, nor should we try to do so. Sunstein shows why free societies must generally allow falsehoods and lies, which cannot and should not be excised from democratic debate. A main reason is that we cannot trust governments to make unbiased judgments about what counts as "fake news." However, governments should have the power to regulate specific kinds of falsehoods: those that genuinely endanger health, safety, and the capacity of the public to govern itself. Sunstein also suggests that private institutions, such as Facebook and Twitter, have a great deal of room to stop the spread of falsehoods, and they should be exercising their authority far more than they are now doing. As Sunstein contends, we are allowing far too many lies, including those that both threaten public health and undermine the foundations of democracy itself.
