In Fixing Democracy, Javier Corrales develops a theory of institutional origins that concentrates on constitutions and levels of power within them. He reviews numerous Latin American constituent assemblies and constitutional amendments to explore why some democracies expand rather than restrict presidential powers and why this heightened presidentialism discourages democracy. His signal theoretical contribution is his elaboration on power asymmetries. Corrales determines that conditions of reduced power asymmetry make constituent assemblies more likely to curtail presidential powers, while weaker opposition and heightened power asymmetry is an indicator that presidential powers will expand. The bargain-based theory that he uses focuses on power distribution and provides a more accurate variable in predicting actual constitutional outcomes than other approaches based on functionalism or ideology. While the empirical focus is Latin America, Fixing Democracy contributes a broadly applicable theory to the scholarship both institutions and democracy.

Yet, since 1958, it has developed one of the few effective, competitive democracies in Latin America. To explain this transformation Daniel H. Levine analyzes the development of modern mass-based political parties with pervasive organizations and commanding strong loyalties; the changing structure and content of social and political conflict; and the gradual emergence of common norms governing political behavior. This book does not pretend to be a general survey of Venezuelan politics. Rather, it is an attempt to understand, for both theoretical and practical purposes, the development of shared "rules of the game" for political action in a heterogeneous society. Once these norms are accepted by key elites, and then imposed on recalcitrant oppositions, they provide a means of controlling and managing political conflict without eliminating it. Mr. Levine's conclusions are based primarily on case studies of specific political conflicts. His study of conflicts over educational reform uncovers the conditions in which a traditional sector of society—Catholic groups and institutions—moved from violent, total opposition to the political system to a position of accommodation. The research breaks down why the social security system reform initiated by Hugo Chávez’ government in Venezuela has come down since its passing in 2002, whereas the social security system reform initiated by Rafael Correa’s government in Ecuador has come along in spite of the obstacles since 2007. All in all, the analysis determined that the struggles over the social security system reforms in both countries remarkably corresponded to each other with regard to their structural conditions, points of contention, and contending actors. In contrast, the analysis established substantial divergences regarding the ways in which the struggles over both reforms came about, due to the divergent development of the struggles for hegemony between government and opposition. These divergences finally brought about the indefinite stagnation of the reform in Venezuela and the advancement of subsequent partial reforms aimed at the universalization of social security in Ecuador.

This process of globalisation raises the possibility of an international legal framework, a possibility which has gained pressing relevance in the wake of the recent global economic crisis. But for any international legal framework to exist, normative agreement between countries, with very different political, economic, cultural and legal traditions, becomes necessary. This work explores the possibility of such a normative agreement through the prism of national constitutional norms. Since 1945, more than a hundred countries have adopted constitutional texts which incorporate, at least in part, a Bill of Rights. These texts reveal significant similarities; the Canadian Charter of Rights and Freedoms, for instance, had a marked influence on the drafting of the Bill of Rights for South Africa, New Zealand and Hong Kong as well as the Basic Law of Israel. Similarly, the drafts of Eastern European constitutions reflect significant borrowing from older texts. The essays in this book examine the depth of these similarities; in particular the extent to which textual borrowings point to the development of foundational values in these different national legal systems and the extent of the similarities or differences between these values and the priorities accorded to them. From these national studies the work analyses the rise of constitutionalism since the Second World War, and charts the possibility of a consensus on values which might plausibly underpin an effective and legitimate international legal order.
