Este sistema hace menos costoso, más eficiente y breve la impartición y administración de justicia. La primera parte, la integra el principio o criterio de oportunidad, a cargo del fiscal y sirve para despresurizar a los órganos de justicia y concentrarlos en los casos graves, evitando seguir desgastantes, costosos e inútiles procesos, cuando en una acusación no hay suficientes evidencias o interés publico en incoar un juicio, pero salvaguardando que el delito no quede impune y se repare el daño. La segunda parte es la justicia alternativa y restaurativa, basada en acuerdos preparatorios o de reconocimiento de culpabilidad, dando lugar a la suspensión condicional del proceso a prueba o al juicio abreviado a cargo del juez de control. La tercera parte se basa en el principio de presunción de inocencia. El juez de control o de garantía, se asegurará que toda imputación se formule respetando las garantías del acusado y la víctima. El juez de control preparará el juicio, en el que dos equipos, el acusador (fiscal-victima) y el defensor (imputado-defensa) cuenten con todos los elementos para enfrentarse en igualdad de fuerzas. La cuarta parte es el juicio oral, a cargo del juez de instrucción, ante cuya presencia se desahogarán las pruebas, sentenciando en base a lo que vio y escuchó. El juez de ejecución se encargará de que sea ejecutada la pena. LOS JUICIOS SOBREVIVEN A LAS PERSONAS: La eficacia del sistema acusatorio, determina que al juicio oral lleguen menos del 10% de las causas penales, principalmente las que más ofenden a la sociedad. Ningún trámite o juicio largo beneficia al patrimonio y seguridad jurídica del ciudadano. Nuestra ineficiente justicia, causada principalmente por un amparo, que la Corte ha desfigurado y convertido en una tercera (Amparo indirecto), cuarta (Directo) y quinta instancia (Revisión y Ejecución), solo ha servido para engrosar una costosa y enredada burocracia federal de justicia. Los constantes criterios contradictorios y dilatorios del Poder Judicial Federal, han hecho que las personas se mueran, antes de ver concluido su juicio.

The prospects for an ‘enabling environment’ for SDG implementation are hampered by persistently high levels of homicides and impunity (SDG16). Turning Mexico’s Armed Forces into ‘first development partner of choice’ is problematized as regards their reach in infrastructure megaprojects and social welfare programs, in the overall context of the ‘de-risking state’ favoring private capital.
