Book excerpt: This book argues that an effective way to curb the significant problem of environmental degradation in Nigeria's Niger Delta region and preserve its environment for posterity is by tweaking the ethic underlying environmental protection laws in Nigeria to a less anthropocentric one. The wanton degradation has several causes including an overly anthropocentric view of law, life and the natural world. The Nigerian environmental legal order is flawed in the following ways: non-justiciability of Constitutional provisions on environmental matters; insufficient deterrence of some sanctions or inadequate enforcement of others; inadequate compensation; insufficient use of injunctive relief; and difficulty of victims of environmental degradation in the region to be availed by relevant foreign regimes due to lack of financial resources, ignorance, poor education, insufficiency of legal and scientific resources and inadequate action by Government law officers.The book explores some improvements that have been suggested in existing literature which should be adopted to make the extant system work better. It however argues that the impact of such reforms would be enhanced if the ethic underlying the Nigerian environmental protection laws is changed to a less anthropocentric one; and one way of doing so is to constitutionalize nature's right to exist for posterity. This right will be enforceable by individuals, Non-Governmental Organisations and Environmental Protection Agencies, any or all of whom will act as a 'guardian' for nature in a specialist environmental court. This proposal is in no way a 'magic bullet' but can help promote social change so long as there is genuine involvement of all categories of stakeholders - government and non-governmental institutions, communities and private sector organizations.

Book excerpt: Fidelis Allen situates violent conflict in the Niger Delta in the context of failure by government to effectively implement relevant oil-related environmental policies intended to achieve sustainable development, arguing that oil and environment-related conflicts in the region are reflections of this failure. This failure is premised on the notion that the goal of sustainable development, as clearly outlined in Nigeria’s National Environmental Policy and implied in various other policies, can be pursued through the activities of government, individuals and business organisations that are capable of engendering economic and social progress for communities that depend on the environment for their survival. In fact, available evidence shows that government and oil company activities (or failures to act) actually contribute to the despoliation of the environment in the Niger Delta. Despite existing environmental legislations and guidelines, unsafe waste disposal, flaring of gas and oil spillage remain key features of oil industry operations in the Niger Delta. Not surprisingly, the book highlights a lack of synergy between government and oil company activities, and the attainment of sustainable development as a key goal of the environmental policy of the government. In other words, the activities of the government and oil companies do not sufficiently promote sustainable development. The net consequence is reflected in the frustrations of local justice and environmental movement groups about the political processes which deter (rather than enable) their agitation for improvements in local living conditions and development in the Niger Delta. Over time, those frustrations begin to manifest at different levels, including aggressive and violent behaviours against oil companies and government security agencies for their contributory roles.

Book excerpt: Embracing the reality of biophysical limits to growth, this volume uses the technical tools from ecological economics to recast the Sustainable Development Goals (SDGs) as Ecological Livelihood Goals – policy agendas and trajectories that seek to reconcile the social and spatial mobility and liberty of individuals, with both material security and ecological integrity. Since the 1970s, mainstream approaches to sustainable development have sought to reconcile ecological constraints with modernization through much vaunted and seldom demonstrated strategies of ‘decoupling’ and ‘dematerialization’. In this context, the UN SDGs have become the orchestrating drivers of sustainability governance. However, biophysical limits are not so easily sidestepped. Building on an ecological- economic critique of mainstream economics and a historical- sociological understanding of state formation, this book explores the implications of ecological limits for modern progressive politics. Each chapter outlines leverage points for municipal engagement in local and regional contexts. Systems theory and community development perspectives are used to explore under- appreciated avenues for the kind of social and cultural change that would be necessary for any accommodation between modernity and ecological limits. Drawing on ideas from H.T. Odum, Herman Daly, Zigmunt Bauman, and many others, this book provides guiding research for a convergence between North and South that is bottom-up, household-centred, and predicated on a re- emerging domain of Livelihood. In each chapter, the authors provide recommendations for reconfiguring the UN’s SDGs as Ecological Livelihood Goals – a framework for sustainable development in an era of limits. This book will be of great interest to students and scholars of ecological economics, socio- ecological systems, political economy, international and community development, global governance, and sustainable development.
