Les questions soulevées sont toutefois aujourd’hui plus particulièrement marquées par les mutations du travail, les changements d’organisation de la production et des services, l’influence des technologies de la communication, la globalisation de l’économie, la coexistence de sociétés culturellement homogènes ou multiculturelles. Au plan international, une universalisation des libertés est à l'œuvre, singulièrement au travers de l’affirmation de droits fondamentaux de la personne en situation d’emploi. Pour autant, la mise en comparaison de droits nationaux révèle bien des résistances à la reconnaissance des libertés individuelles dans le cadre des relations de travail. Sans comptabiliser, pays par pays, le permis, le possible et l’interdit, on entend ici affronter l’ambivalence de la liberté dans les relations de travail. De même qu’on distingue « égalité formelle » et « égalité réelle », on se doit en effet de prendre conscience du sens et des risques d’une liberté formelle visant à supprimer les interdits ; seule la liberté substantielle, réelle, paraît permettre de multiplier les possibles. Certains « permis » peuvent ainsi diminuer la liberté, alors que « l’interdit » peut parfois s’avérer libérateur, protecteur de la liberté.

Cet ouvrage propose une analyse approfondie du concept des droits et principes fondamentaux au travail, de la Déclaration de l’OIT qui l’a scellé, ainsi que de son contenu conventionnel. Il s’interroge en particulier sur le statut coutumier des droits fondamentaux au travail, sur la signification de la Déclaration de même que sur sa place au sein du droit international, en insistant tant sur son importance pour l’OIT que sur ses effets hors de l’OIT. Il s’en dégage que même si la Déclaration est indubitablement le reflet d’un contexte contemporain peu favorable à la réglementation du travail, elle constitue néanmoins une étape substantielle dans le travail de l’OIT pour promouvoir une paix universelle basée sur la justice sociale.
