Pourtant, cette affirmation ne résiste pas à l’analyse. D’une part, il est difficile d’identifier concrètement à quoi renvoie cette « loi ». D’autre part, malgré une formulation faussement évocatrice d’un mécanisme de conflit de lois, ladite « loi » n’est pas directement appliquée. En revanche, le droit communautaire contient diverses techniques portant une attention particulière au système juridique de l’Etat d'origine des titulaires des libertés de circulation, que l’on peut regrouper au sein d’un concept d’origine. La « reconnaissance mutuelle », la règle du « home country control » et le « principe du pays d'origine » sont les principales déclinaisons de ce concept. L’analyse sous l’angle du droit international privé permet de mettre en lumière de réelles interférences normatives et méthodologiques entre les expressions du concept d’origine et cette matière. Ainsi, l’intervention de certaines expressions de ce concept peut être source de tensions avec les règles du droit international privé. En outre, leur mise en œuvre technique se réalise à la manière tantôt d’une technique de conflit de lois lato sensu, tantôt d’un procédé de reconnaissance au sens du droit international privé. Dans ce contexte, on peut dès lors se demander si, de lege ferenda, le concept d’origine ne pourrait pas être la matrice de nouvelles techniques de droit international privé communautaire.

The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.
