Available in PDF, EPUB and Kindle. Book excerpt: The Draft Children (Contact) and Adoption Bill (Cm. 6462; ISBN 0101646224) published in February 2005, contains provisions in relation to the enforcement by the family courts of contact orders, as well as arrangements for intercountry adoptions. The Bill is intended to assist in the implementation of the Green Paper "Parental separation: children's needs and parents' responsibilities" (Cm. 6273, July 2004, ISBN 0101627327), reinforcing the Government's view that a child should continue to have a meaningful relationship with both parents after a parental separation, so long as it is safe and the child's best interests. The Committee's report focuses on the workability, effectiveness and proportionality of the draft Bill, and also considers whether it fails to include provisions which might have useful in advancing its aims. Topics discussed include: the power to make contact activity directions; the role of CAFCASS and Family Assistance Orders (FAOs); issues relating to enforcement orders; compensation for financial loss; the welfare checklist in the Children Act 1989; and adoptions with a foreign element.

Available in PDF, EPUB and Kindle. Book excerpt: A tension lies at the heart of family law. Expressed in the language of rights and duties, it seeks to impose enforceable obligations on individuals linked to each other by ties that are usually regarded as based on love or blood. Taking a contextual approach that draws on history, sociology and social policy as well as law and legal theory, this book examines the concept of obligation as it has been developed in family law and the difficulties the law has had in translating it from a theoretical and ideological concept into the basis of enforceable actions and duties. Increasingly, the idea of commitment has been offered as the key organising principle for the recognition of family relationships, often as a means of rebutting claims that family ties are becoming attenuated, but the meaning and scope of this concept have not been explored. The book traces how the notion of commitment is understood and how far it has come to be used as a rationale for imposing the core legal obligations which underpin care and caring within families.

Cases are at the heart of family law and this textbook offers unrivalled case detail, with comprehensive summaries of key cases throughout the text to ensure students understand the development of family law legislation through the courts. Further case discussion is fully incorporated throughout the text to demonstrate complex points of law and offer a useful starting point for further research and debate. The text also includes a range of further features to support students studying the subject for the first time, including legislation extracts, contextual chapter introductions, and further reading advice, alongside a clear and engaging writing style.

This book was released on 2007-03-15 with total page 122 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's report examines the Government's proposals to reform the child support system, as set out in the White Paper "A new system of child maintenance" (Cm. 6979, ISBN 9780101697927) published in December 2006, and following on from the report by Sir David Henshaw (Cm. 6894, ISBN 9780101689427) published in July 2006. The Committee welcomes the Government's reform proposals, including the eventual replacement of the Child Support Agency by a new body (Child Maintenance and Enforcement Commission (C-MEC)) in 2008 and the fundamental shift proposed towards maintenance agreements privately agreed between parents. However, concerns are raised over the lack of detail for proper scrutiny of how the new system will work, particularly in relation to the provision of advice and guidance services. The report also highlights a number of inherent contradictions between the principles and practicalities of the proposals, for example how the reforms will impact on child poverty targets in relation to parents on welfare benefits, as well as regarding the transition arrangements for the transfer of existing cases onto the new scheme run by C-MEC. Concerns are also raised that whatever the merit of joint birth registration, tagging this highly sensitive matter onto child maintenance legislation will have wider ramifications for the family law system.
