In the mid-1970s, a reform movement started in the United States, where there was considerable concern about then ongoing medical malpractice crises. Since the beginning of the current century, France, Germany and Italy have passed statutes that aim to reform medical liability rules. Thus, it is first interesting to assess whether any medical malpractice crises have been identified in these systems and, second, how these have been faced through the passing of new statutes on the continent. Accordingly, the first chapter explores the idea of medical malpractice crisis and its relationship with the insurance market, also considering the reflections of American scholars. It then reconstructs the French, German and Italian legal frameworks, as well as their insurance and litigation contexts, reviewing and commenting on the quantitative evidence that was collected before the reforms. The second chapter briefly summarises the debate on medical malpractice reforms in France, Germany and Italy. It then analyses the statutes that have been passed, distinguishing between reforms that consolidate case law and reforms that introduce innovative solutions, sometimes repealing court-developed doctrines. In particular, the chapter examines in a comparative perspective the diff erent options adopted in these civil law countries with regard to the rules on liability, burden of proof, statute of limitations and damages. Moreover, the chapter examines the reforms of insurance, procedural and evidence law, to the extent they affect medical malpractice cases. The third chapter reviews and analyses the current available data related to medical malpractice litigation and insurance after the reforms adopted in France, Germany and Italy, in order to find out evidence of their effectiveness and efficiency. It also highlights some aspects of medical malpractice law that still belong to the domain of the judiciary. It finally points out which problems may be addressed by the legislatures and what further data should be collected in the future. This work may interest legal scholars, healthcare providers, insurers and policymakers.

Drawing on ethnographic research in an Italian criminal court, the book details how citizenship and national belonging not only matter, but are matters reproduced, elaborated, and negotiated throughout the judicial process, exploring the implications of this development for the understanding of penal power and the role of criminal courts. Set in the context of the growing intersection between migration control and penal power, Delivering Justice to Non-Citizens explores whether and how instances of border control have seeped into judicial practices. In doing so, it fills a significant gap in the scholarship on border criminology by considering a rather unexplored actor in the field of migration studies: criminal courts. Based on a year of courtroom ethnography in Turin, Delivering Justice to Non-Citizens relies on interviews with courtroom actors, courthouse observations, analysis of court files, together with local media analysis, to provide a vivid image of judicial practices towards foreign defendants in a medium-size criminal court. It considers and balances the distinctive traits of the local context with ongoing global processes and transformations and adds much needed insights into how global processes impact local realities and how the local, in turn, adjusts to global challenges. Through instances of everyday justice, the book calls attention to how migration control has silently seeped into the judicial realm. The book will be of interest to students and academics in sociology, criminology, law, penology, and migration studies. Book excerpt: This book analyzes how variations in the traditional pillars of Italian foreign policy (the US, the EU and multilateralism) can be related to changes in the US-led international hegemonic order and to the role that Italy plays within that order. To explore these variations, the book proposes an analysis of the Italian voting and sponsoring behavior at the UN in the period 2000-2017, in both the General Assembly and the Security Council, and emphasizes the importance of the latter forum to detect how Italian behavior reflects changes at the international system level. By focusing on the Italian coalition behavior, the book explores how Italy as a status seeking middle power has traditionally played the role of coalition facilitator, adapting its foreign policy to be part of a coalition of European states and building on this coalition to increase its contribution to the maintenance of the international system in support of the US-led order. Ultimately this behavior also contributed to its status. However, at a moment when traditional coalitions are reshuffling, and elements of uncertainty are present, elements of volatility are present in Italian foreign policy, especially in the choice of intra-European coalition partners. Italy still builds on a coalition of European states and still does so in support of the US and its authority in the international hegemonic order. But changes in the bargaining environment are making the facilitation of a coalition of European states more difficult and less rewarding. The book also highlights ongoing challenges at both the domestic and international level that might lead to more marked discontinuities in the traditional Italian foreign policy behavior
