Available in PDF, EPUB and Kindle. Book excerpt: The idea of covenant was at the heart of early New England society. In this singular book David Weir explores the origins and development of covenant thought in America by analyzing the town and church documents written and signed by seventeenth-century New Englanders. Unmatched in the breadth of its scope, this study takes into account all of the surviving covenants in all of the New England colonies. Weir's comprehensive survey of seventeenth-century covenants leads to a more complex picture of early New England than what emerges from looking at only a few famous civil covenants like the Mayflower Compact. His work shows covenant theology being transformed into a covenantal vision for society but also reveals the stress and strains on church-state relationships that eventually led to more secularized colonial governments in eighteenth-century New England. He concludes that New England colonial society was much more "English" and much less "American" than has often been thought, and that the New England colonies substantially mirrored religious and social change in Old England.

Available in PDF, EPUB and Kindle. Book excerpt: The fundamental, inalienable rights and privileges set forth in the Bill of Rights represent the very foundations of American liberty. The Complete Bill of Rights is a documentary record of the process by which these rights and privileges were defined and recorded as law. Now in its second edition, The Complete Bill of Rights contains double the content featured in the first edition. This new edition includes all the background texts for the origins and debate of the ratification of the Bill of Rights and presents them clause by clause in a complete, accurate, and accessible format. Arranged in chronological order, the work presents each clause in its finished form, and traces its development from its proposal through drafting through adoption. Cogan presents every draft of the text and every documentary source, including state convention proposals, state, colonial, and English constitutional texts, sources in caselaw and treatises, and State and Colonial statutory and decisional law. He includes data from diaries and correspondence, pamphlets and newspapers, as well as the Congressional and State debates, including the correspondence of George Washington, Thomas Jefferson, James Madison, and John Adams among many others who debated the issues that the Supreme Court considers law today. The book also contains each version of the drafts from the manuscript collections of the National Archives and Library of Congress. The result is the most detailed and useful record of the debate over the Bill of Rights available. This first new edition since 1997 substantially expands on the previous edition, providing the same invaluable texts for two fundamental protections of liberty found in the Constitution of 1789 (though not in the Bill of Rights): the protections under habeas corpus and the privileges and immunities clauses. Each chapter expands the background discussion of rights, and provides pertinent texts in contemporary legal dictionaries to meet the increasing interest of federal and state courts in additional sources for interpretation. The second edition also provides a chapter-by-chapter discussion of rights by treatise and abridgement writers in addition to Blackstone. Finally, all margin notes and footnotes in the dictionaries and treatises are included, so the reader has access to the totality of the original statues and case law upon which the drafters relied. The Complete Bill of Rights is the only comprehensive collection of texts essential to understanding the Bill of Rights. Organized in an accessible and practical manner, it is an invaluable tool for law students, judges, lawyers, and law clerks, as well as scholars of the law, history, and political science.

Available in PDF, EPUB and Kindle. Book excerpt: In a major reinterpretation of American political thought in the revolutionary era, Marc Kruman explores the process of constitution making in each of the thirteen original states and shows that the framers created a distinctively American science of politics well before the end of the Confederation era. Suspicious of all government power, state constitution makers greatly feared arbitrary power and mistrusted legislators' ability to represent the people's interests. For these reasons, they broadened the suffrage and introduced frequent elections as a check against legislative self-interest. This analysis challenges Gordon Wood's now-classic argument that, at the beginning of the Revolution, the founders placed great faith in legislators as representatives of the people. According to Kruman, revolutionaries entrusted state constitution making only to members of temporary provincial congresses or constitutional conventions whose task it was to restrict legislative power. At the same time, Americans maintained a belief in the existence of a public good that legislators and magistrates, when properly curbed by one another and by a politically active citizenry, might pursue.

Available in PDF, EPUB and Kindle. Book excerpt: In May 1776 more than two hundred Indian warriors descended the St. Lawrence River to attack Continental forces at the Cedars, west of Montreal. In just three days’ fighting, the Native Americans and their British and Canadian allies forced the American fort to surrender and ambushed a fatally delayed relief column. In Down the Warpath to the Cedars, author Mark R. Anderson flips the usual perspective on this early engagement and focuses on its Native participants—their motivations, battlefield conduct, and the event’s impact in their world. In this way, Anderson’s work establishes and explains Native Americans’ centrality in the Revolutionary War’s northern theater. Anderson’s dramatic, deftly written narrative encompasses decisive diplomatic encounters, political intrigue, and scenes of brutal violence but is rooted in deep archival research and ethnohistorical scholarship. It sheds new light on the alleged massacre and atrocities that other accounts typically focus on. At the same time, Anderson traces the aftermath for Indian captives and military hostages, as well as the political impact of the Cedars reaching all the way to the Declaration of Independence. The action at the Cedars emerges here as a watershed moment, when Indian neutrality frayed to the point that hundreds of northern warriors entered the fight between crown and colonies. Adroitly interweaving the stories of diverse characters—chiefs, officials, agents, soldiers, and warriors—Down the Warpath to the Cedars produces a complex picture, and a definitive account, of the Revolutionary War’s first Indian battles, an account that significantly expands our historical understanding of the northern theater of the American Revolution.

Book excerpt: This book, the first to describe women medical practitioners other than midwives in the colonial period, emphasizes that medical care was part of every woman's work. The Healer's Calling uses memorable anecdotes, engaging characters, and medical oddities to tell the fascinating story of the practice of household medicine in early America. Rebecca J. Tannenbaum points out that housewives provided much of the medical care available in the seventeenth century. Elite women cared for the indigent in their towns and used medical practice to make influential connections with powerful men; "doctresses" or "doctor women" supported themselves with their practices and competed directly with male physicians; and midwives were crucial "expert witnesses" in cases of fornication, murder, and witchcraft. Yet there were limits to the authority of women's healing communities, with consequences for those who overstepped the bounds. By setting women's practice in the context of contemporary medicine, gender roles, and community norms, Tannenbaum also reveals the relationship between women's medical practice and witchcraft accusations. Tannenbaum examines colonial America's full range of medical options—including the work of classically trained male doctors and male lay practitioners—with a keen eye to the interactions and tensions between men and women in the realm of healing.

Available in PDF, EPUB and Kindle. Book excerpt: In this book about families--those of the various native peoples of southern New England and those of the English settlers and their descendants--Gloria Main compares the ways in which the two cultures went about solving common human problems. Using original sources--diaries, inventories, wills, court records--as well as the findings of demographers, ethnologists, and cultural anthropologists, she compares the family life of the English colonists with the lives of comparable groups remaining in England and of native Americans. She looks at social organization, patterns of work, gender relations, sexual practices, childbearing and childrearing, demographic changes, and ways of dealing with sickness and death. Main finds that the transplanted English family system produced descendants who were unusually healthy for the times and spectacularly fecund. Large families and steady population growth led to the creation of new towns and the enlargement of old ones with inevitably adverse consequences for the native Americans in the area. Main follows the two cultures into the eighteenth century and makes clear how the promise of perpetual accessions of new land eventually extended Puritan family culture across much of the North American continent.
