Available in PDF, EPUB and Kindle. Book excerpt: When Judge John Dixon was found on the floor of his home office with a gunshot wound to the head, there was no question of foul play. Behind the locked door of his office, Judge Dixon shot himself with favorite shotgun. The only question is, was this an accident—or suicide? Plaintiff Mary Dixon demands that Providential Life Insurance Company pay on her husband’s $1 million life insurance policy, taken out shortly before his death. Providential refuses, citing the suicide provision of the policy. The medical examiner determined the death was accidental, but Providential claims the medical examiner's conclusion was tainted by his friendship with the judge and a hasty investigation, and that Dixon's death was, in fact, a suicide. Would this seemingly happy, well-respected judge to kill himself? Was Judge Dixon the churchgoing social conservative that his public persona suggested? Did his shotgun accidentally discharge while he, an experienced hunter and gun owner, was cleaning it in a darkened room—or was he troubled by a secret that was about to be exposed and made suicide seem like his only way out? This well-balanced file challenges advocates for both the plaintiff and the defendant. Programs using it see equal numbers of verdicts for both the plaintiff and the defense. There are five witnesses for the plaintiff and four for the defendant. Dixon v. Providential Life Insurance Company has a courtroom technology focus and includes electronic evidence in the form of photographs, diagrams, documents, emails, and text messages. It includes a web link to color versions of all exhibits, the audio clip of Mary Dixon’s 911 call, and deposition video clips to use for impeachment purposes. The Seventh Edition is based on the original case file by James H. Seckinger, as updated and upgraded by Edward R. Stein and Frank D. Rothschild.

Available in PDF, EPUB and Kindle. Book excerpt: Robin Powell has filed a wrongful death suit against SuperPulper, Inc. after her husband, Steven Powell, died as a result of falling into a hydrapulper manufactured by SuperPulper. The complaint alleges that the hydrapulper was defective because there were not sufficient guards and warnings on and around the hydrapulper. The case file includes two witnesses for each side as well as engineering and pain and suffering experts. It can be used as a liability case only or, with the addition of the pain and suffering experts, a liability and damages case. This detailed fact pattern and supporting illustrative exhibits will provide law students and trial lawyers with an opportunity to creatively and effectively argue their respective theories. Powell v. SuperPulper, Inc. can be applied to teach trial advocacy techniques on both liability and/or damages. In that regard, the liability and damage phase contains its own witnesses and exhibits to facilitate bifurcation or to allow trial as one matter.

Book excerpt: In this trademark infringement case, Dr. Stanley Love, a dermatologist, alleges that Regency Plastic Surgery, PC, has infringed his common-law trademark of the "The Love Look" by using "The Look of Love" as its marketing slogan. Dr. Love is seeking injunctive relief and damages. For more than a decade, Dr. Stanley Love, a dermatologist, has marketed his cosmetic surgery practice with "The Love Look" as his slogan. Regency, a New York City practice that has opened branches around the country, registered the service mark "The Look of Love" with the U.S. Patent and Trademark Office and began using the slogan in all its marketing. Regency opened a branch practice in Dr. Love's area about two years ago. Regency denies liability, claiming that Dr. Love had no common-law trademark because "The Love Look" is merely descriptive and therefore Dr. Love could acquire no common-law trademark rights in the slogan. Regency also claims that even if "The Love Look" has acquired trademark protection, Regency did not infringe the trademark. Finally, Regency claims that Dr. Love's claims are barred by laches and the statute of limitations. The Love v. Regency case file has contains the following witnesses: Four fact witnesses (two per side) Two liability expert witnesses Two damages expert witnesses Because of growing media influence on litigation, the second edition of Love v. Regency also contains internet exhibits including: ·Websites for both businesses ·Facebook pages of customers ·Yelp-style reviews The author has created a teaching manual to help the professor with testimony and to highlight special impeachment problems. Students will have easy access to color copes of all exhibits and media files online through NITA’s website.
