Dopo la riforma della filiazione del 2012-2013, la quale, pur senza il coraggio e la definitività che alcuni si attendevano, ha finalmente abolito la differenza tra figli legittimi e naturali, da tempo invocata e mai attuata, vi è stata l’approvazione della legge 162 del 2014, con la quale il principio, a lungo mantenuto, secondo cui non bisognava rendere più facili le separazioni ed i divorzi, per non favorire una mentalità divorzista e non consapevole della serietà e delle gravi conseguenze di tale scelta, è stato ampiamente messo in discussione. Subito dopo, è giunta anche al traguardo dell’approvazione parlamentare la legge sul divorzio breve, da lungo tempo in attesa e spesso finita su di un binario morto, per le medesime ragioni citate a proposito della legge 162. Altri importanti passaggi parlamentari sono poi intervenuti relativi all’abolizione del “privilegio” maschile in ordine al cognome dei figli ed in ordine alle unioni civili tra persone dello stesso sesso, anch’esse, fino a poco tempo fa, ritenute molto lontane dalla possibilità di una regolamentazione per legge. Né bisogna dimenticare altri disegni di legge avviati verso l’approvazione, come quello che aumenta la possibilità di avere consapevolezza delle proprie origini per i figli non riconosciuti dalla madre alla nascita, nell’ambito di un discorso che sembra finalmente voler valorizzare, in tema di filiazione, il principio di verità, strettamente congiunto al principio di trasparenza ed ispirato ai diritti fondamentali della persona.
