Available in PDF, EPUB and Kindle. Book excerpt: This book is an important contribution to the current lively debate about the relationship between law and society in the Roman world. This debate, which was initiated by the work of John Crook in the 1960's, has had a profound impact upon the study of law and history and has created sharply divided opinions on the extent to which law may be said to be a product of the society that created it. This work is a modest attempt to provide a balanced assessment of the various points of view. The chapters within this book have been specifically arranged to represent the debate. It contains an introductory chapter by Alan Watson, whose views on the relationship between law and society have caused some controversy. In the remaining chapters a distinguished international group of scholars address this debate by focusing on studies of law and empire, codes and codification, death and economics, commerce and procedure. This book does not purport to provide a complete survey of Roman private law in light of Roma

Available in PDF, EPUB and Kindle. Book excerpt: This book is not about the rules or concepts of Roman law, says Alan Watson, but about the values and approaches, explicit and implicit, of those who made the law. The scope of Watson's concerns encompasses the period from the Twelve Tables, around 451 B.C., to the end of the so-called classical period, around A.D. 235. As he discusses the issues and problems that faced the Roman legal intelligentsia, Watson also holds up Roman law as a clear, although admittedly extreme, example of law's enormous impact on society in light of society's limited input into law. Roman private law has been the most admired and imitated system of private law in the world, but it evolved, Watson argues, as a hobby of gentlemen, albeit a hobby that carried social status. The jurists, the private individuals most responsible for legal development, were first and foremost politicians and (in the Empire) bureaucrats; their engagement with the law was primarily to win the esteem of their peers. The exclusively patrician College of Pontiffs was given a monopoly on interpretation of private law in the mid fifth century B.C. Though the College would lose its exclusivity and monopoly, interpretation of law remained one mark of a Roman gentleman. But only interpretation of the law, not conceptualization or systematization or reform, gave prestige, says Watson. Further, the jurists limited themselves to particular modes of reasoning: no arguments to a ruling could be based on morality, justice, economic welfare, or what was approved elsewhere. No praetor (one of the elected officials who controlled the courts) is famous for introducing reforms, Watson points out, and, in contrast with a nonjurist like Cicero, no jurist theorized about the nature of law. A strong characteristic of Roman law is its relative autonomy, and isolation from the rest of life. Paradoxically, this very autonomy was a key factor in the Reception of Roman Law--the assimilation of the learned Roman law as taught at the universities into the law of the individual territories of Western Europe.

Book excerpt: On December 12 and 13, 2013, the Department of Public Law, Jurisprudence and Legal History at Tilburg Law School convened an international conference on legal history in honour of Dr. Olga Tellegen-Couperus, who in August of that year had formally retired from Tilburg University after 36 years. Colleagues and friends came from the Netherlands and Europe to celebrate their years of professional exchange and comradeship with Olga. During two enthralling days, those who had known Olga for years and had developed long standing friendships with her mingled with other participants, including Olga's PhD students. The different topics discussed mirrored Olga's broad interests in proper legal history, Roman law, rhetoric and Common Law. All possible intertwining relations between those legal disciplines were brought forward in sound scholarly presentations, discourses and humorous talks. All participants took pleasure in sharing their academic research, engaging in debate and enjoying each other's company. At the close of the conference, the plan was devised to capture the atmosphere of the gathering in a booklet. The result is this liber amicorum for the beloved and highly respected Olga Tellegen-Couperus. The title of this festschrift is a true reflection of the thorough and enthusiastic way in which Olga committed herself to her academic career. [Subject: Legal History, Law]

Available in PDF, EPUB and Kindle. Book excerpt: This book examines legal language as a language for special purposes, evaluating the functions and characteristics of legal language and the terminology of law. Using examples drawn from major and lesser legal languages, it examines the major legal languages themselves, beginning with Latin through German, French, Spanish and English. This second edition has been fully revised, updated and enlarged. A new chapter on legal Spanish takes into account the increasing importance of the language, and a new section explores the use (in legal circles) of the two variants of the Norwegian language. All chapters have been thoroughly updated and include more detailed footnote referencing. The work will be a valuable resource for students, researchers, and practitioners in the areas of legal history and theory, comparative law, semiotics, and linguistics. It will also be of interest to legal translators and terminologists.

Book excerpt: 'Halliday's investigations into grammatical metaphor take us deeply into the way we construct and expand meanings, starting with representations of concrete experienced events and ending with theoretical worlds populated by abstract entities linked through generalized relations and causalities. He finds these processes most strikingly in the development of the modern sciences that have historically created robust virtual worlds of theory from observable material events. He sees the same processes of grammatical metaphor as children learn to participate in our built symbolic environment, particularly as they are introduced to these meaning systems in schools, an institution designed expressly for that purpose.' Professor Charles Bazerman, University of California, Santa Barbara.
