La tesi centrale del libro “Diritto penale ed enti collettivi” è che a partire dal 2001, con l’entrata in vigore del d.lgs. 231/01, non solo è stato superato il principio illuministico Societas delinquere non potest, ma è stata altresì abbattuta la tradizionale distinzione tra disciplina dell’ente lecito e reati associativi. Attraverso la progressiva estensione agli enti collettivi delle misure di prevenzione previste nel Codice antimafia e nella legislazione complementare in materia di contrasto alla corruzione, ha infine preso vita una terza categoria, quella dell’ente “sospetto”, nella quale le diverse forme di diritto penale emergenziale finiscono per convergere, creando un evidente contrasto con i principi fondamentali che regolano la libertà di associazione e d’impresa.
