In presenza di queste trasformazioni, qual è stata l’interpretazione e l’applicazione delle figure delittuose dedicate alla famiglia contenute nel codice penale, approvato durante il fascismo? Se e come si sono trasformati i reati posti a tutela della morale familiare, dello stato di famiglia, del matrimonio, degli obblighi di assistenza? Il volume offre una esaustiva ricostruzione di come il diritto penale vivente interagisce, si misura e interviene nell’ambito della “famiglia”, intesa in senso più ampio rispetto all’inquadramento che ne dà il codice penale. Viene presa in esame quella “materia” che ormai viene definita “diritto penale della famiglia”, attraverso una attenta analisi, soprattutto della giurisprudenza, non limitandosi a ricostruire il funzionamento degli istituti che tradizionalmente vengono riferiti a tale disciplina. Così, oltre a passare in rassegna critica i reati ricompresi nel titolo XI del codice penale dedicato ai delitti contro la famiglia, il volume amplia il campo di osservazione anche ad altri settori, in cui i relativi illeciti si caratterizzano, spesso, per essere realizzati o occasionati in ambiti familiari, come ad esempio l’omicidio aggravato dalle relazioni familiari, l’infanticidio, il reato di atti persecutori, volgendo l’attenzione anche ad illeciti apparentemente più distanti dai temi attinenti alla famiglia, come la prostituzione minorile, i reati di pedopornografia, senza trascurare le importanti ricadute sul piano processuale, a cui sono dedicati gli ultimi capitoli sulla facoltà di astensione dei prossimi congiunti e dei conviventi, sui soggetti vulnerabili nel processo penale.

The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of the institution as ‘the first, original and essential manifestation of law’.
