Sul piano dei diritti, il legislatore, si dibatte tra l’esigenza di riconoscere e salvaguardare il principio fondamentale di tutela dell’unità familiare e la necessità di dettare norme tese alla regolamentazione dei flussi in modo tale da garantire la sicurezza nazionale. Le diverse riforme, pertanto, si sono confrontate con il dovere di garantire il difficile equilibrio tra diritto della famiglia, diritto all’affettività e potestà statuale di disciplinare, nel quadro degli strumenti internazionali, il fenomeno migratorio. L’opera approfondisce particolarmente le tematiche del ricongiungimento familiare, non solo illustrando la disciplina positiva, ma prendendo in considerazione l’atteggiamento della giurisprudenza, soprattutto quella costituzionale, rispetto all’evoluzione legislativa negli anni. In linea con l’esigenza di armonizzare il diritto dell’immigrazione con gli strumenti internazionali, l’opera è permeata da riferimenti ai trattati internazionali che dettano i principi fondamentali ed alle Direttive europee che fanno da cornice alla disciplina positiva. Non manca una disamina delle procedure amministrative, consentendo l’individuazione delle prassi che facilitano il rapporto con la pubblica amministrazione. Infine, l’opera prende in considerazione anche gli istituti relativi al soggiorno dei minori, tanto quelli accompagnati quanto quelli non accompagnati.
