O adolescente que praticar um ato infracional poderá judicialmente ser submetido ao cumprimento de medidas socioeducativas e/ou protetivas. As medidas socioeducativas podem variar desde a advertência até a internação; enquanto que as medidas protetivas se destinam à efetivação de suas liberdades públicas. Nessa obra, tratou-se também do Direito da Criança e do Adolescente, então, criado no Brasil a partir do advento da Constituição da República de 1988, quando, então, adotou-se a doutrina da proteção integral. A doutrina da proteção integral pode ser entendida como os direitos humanos especificamente destinados à criança e ao adolescente, para fins de emancipação subjetiva. Isto é, para a melhoria da qualidade de vida individual e coletiva desses novos sujeitos de Direito (emancipação subjetiva). De igual maneira, destaca-se as atribuições legalmente destinadas ao Conselho Tutelar, que, apesar de não ser responsável pelo acompanhamento do cumprimento da medida socioeducativa judicialmente determinada a adolescente, tem o dever legal de fiscalizar as entidades de atendimento socioeducativo em que se cumpre as medidas tanto em meio aberto (liberdade assistida e prestação de serviços à comunidade), quanto em meio fechado (semiliberdade e internação). Em relação à responsabilização diferenciada de adolescente, apresenta-se a discussão sobre os marcos teórico-pragmáticos que poderiam legitimamente fundamentar tanto a aplicação judicial de medidas legais (protetivas e socioeducativas), quanto o acompanhamento administrativo dos respectivos cumprimentos. Por isso mesmo, destaca-se a tensão entre o discurso decorrente do direito penal juvenil e o discurso sustentado pela doutrina da proteção integral para fins de responsabilização diferenciada do adolescente a quem se atribuiu a prática de uma conduta conflitante com a lei. A responsabilização diferenciada, por isso mesmo, significa a adoção de categorias jurídicas próprias e específicas, então, consagradas no Estatuto da Criança e do Adolescente (Lei n. 8.069/90), e, não diversamente no âmbito do direito penal (juvenil). Ainda, cuida-se também dos aspectos administrativos e jurisdicionalizados que regulamentam o acompanhamento jurídico-legal do cumprimento das medidas socioeducativas judicialmente determinadas a adolescentes, tendo-se em conta a regulamentação específica da denominada Lei do SINASE (Lei n. 12.594/2012). A Lei do SINASE estabelece padrões técnicos administrativos para a constituição e o regular funcionamento das entidades que se destinam ao atendimento socioeducativo, bem como passa a descrever novos princípios para o cumprimento das medidas socioeducativas, e, a previsão de procedimentos incidentais. Paralelamente a tudo isso, tratou-se também da redução da idade de maioridade penal e suas implicações no âmbito do direito da criança e do adolescente, em especial, acerca da jurisdição e do processo, que, na contemporaneidade, constituem-se em garantia desses novos sujeitos de Direito, e, não como instrumental para legitimação da violência como forma de controle social. O ato infracional, isto é, a conduta conflitante com a lei, enquanto pressuposto lógico das medidas socioeducativas, também foi analisado como critério objetivo para limitar a intervenção estatual, aqui, de cunho socioeducativo (sociopedagógico), e, assim, constituir-se como um dos aspectos que também diferenciam essa forma de responsabilização do adolescente. A responsabilização diferenciada, assim, requer a construção de uma instância jurídico-legal própria que, por isso mesmo, requer um marco teórico-pragmático específico, o qual aqui fora denominado de Direito Socioeducacional para fins de asseguramento e de efetivi

Da mesma forma houve a preocupação de verificar de que forma os profissionais do Serviço Social estão discutindo a aplicabilidade das medidas socioeducativas com restrição total de liberdade a fim de inter-relacionar as duas áreas de saberes, Direito e Serviço Social, que trabalham ativa e diretamente com adolescentes envolvidos em atos infracionais no sentido de buscar a garantia de seus direitos, estes previstos na Lei vigente 8.069 de 1990, o já referido Estatuto. O estudo adotou como caminho investigativo o método crítico dialético, pois faz um resgate das legislações anteriores ao Estatuto da Criança e do Adolescente com o objetivo de verificar como esses sujeitos eram tratados e compreendidos pelo Estado e compara tais tratamentos com a Doutrina de Proteção Integral. Ao final buscou-se responder ao seguinte questionamento: Quais correntes teóricas pesquisadas garante de forma mais abrangente a efetivação da Doutrina de Proteção Integral, base do Estatuto da Criança e do Adolescente?
