Book excerpt: This work offers ease of access to the ICJ's judgments and advisory opinions given between 25 March 1949 and 3 February 2012. It seeks to help scholars, practitioners and students of international public law quickly to review the Court’s jurisprudence for precedents in the Court’s "canon" and "case law". It allows the reader to read the judgments and opinions themselves, reduced to the unabbreviated and undistorted essence of the Court’s reasoning. The work contains all the timeless elements of the Court’s jurisprudence in one volume, and a highly detailed index of the relevant terms and phrases of the judgments and advisory opinions.

This book was released on 2023-12-28 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores how courts decide, or ought to decide, in situations of uncertainty. A Court must always decide the case before it, even if the relevant facts remain unclear. The question then arises which party benefits and which party is burdened by that uncertainty. In these cases, the Court must apply the rules on the burden of proof or, more precisely, the burden of persuasion. Their importance for the individual claimant is obvious. The comparison of two domestic systems (one based on common law and the other a traditional code-based legal order) with regard to the issue of burden of proof helps to clarify the terminology and lays the ground for dealing with the burden of proof in international human rights law. Without knowing what can be understood by the term `burden of proof' under domestic law, international lawyers with different domestic law backgrounds are in danger of misunderstanding each other. This may lead to obscuring the problems connected with court decisions involving uncertainty. The study also deals with uncertainties with regard to legislative (general) in contrast to adjudicative (individual) facts and with uncertainties in the framework of predictions in contrast to uncertainties relating to historic facts. It attempts to prepare the ground for dealing more consciously and more consistently with problems of uncertainty in international human rights law. International courts, due to their geographical and cultural distance from the case, usually have less access to the underlying facts. Nevertheless, in order to protect human rights effectively, international courts and tribunals cannot always restrict themselves to reviewing the law, but may also have to decide on the facts. Thus issues relating to decision-making on the basis of uncertain facts, including the burden of persuasion, are even more important in international than in domestic human rights law.

It will prove to be a very useful source for research on and analysis of the jurisprudence of the World Court. Excerpt from the Foreword to this Volume by H. E. Judge Peter Tomka, President, ICJ: “Mr Bimal Patel has assembled an impressive compilation of both institutions’ respective case load, spanning a period of 88 years; namely, from the inception of the PCIJ in 1922 to the ICJ’s recent activities, providing coverage up until 31 December 2010. Patel’s work provides us with succinct but accurate freeze-framed accounts of the contentious and advisory proceedings that made their way from the Court’s docket into orders, advisory opinions and judgments, thereby presenting a completed puzzle of the Court’s work.."

The contributing authors are academic scholars of international law, economics and political sciences; active and former diplomats and UN officials; journalists and members of non-governmental organizations (NGOs), and offer a variety of interesting perspectives. The entries are provided with Internet addresses for further information and are supplemented in the annex with a trilingual list (English-French-German) of the most important institutions and items of the official terminology and a list of information facilities concerning the UN. Readership: scholars and students of international law, international economics and political sciences, teachers, journalists, diplomats and politicians in the parliaments of the UN member states. "This new encyclopedia on the United Nations is a welcome addition to the works of academic research and political analysis covering the organization, its complex goals in the post-cold war era, and its ever broader role in the new millennium. While taking stock of more than half a century's achievements and setbacks, the encyclopedia also reflects the many ways in which the United Nations touches the lives of people everywhere." from the Preface by UN Secretary-General Kofi Annan
