Book excerpt: This concluding volume of The Vietnam War and International Law focuses on the last stages of America's combat role in Indochina. The articles in the first section deal with general aspects of the relationship of international law to the Indochina War. Sections II and III are concerned with the adequacy of the laws of war under modern conditions of combat, and with related questions of individual responsibility for the violation of such laws. Section IV deals with some of the procedural issues related to the negotiated settlement of the war. The materials in Section V seek to reappraise the relationship between the constitutional structure of the United States and the way in which the war was conducted, while the final section presents the major documents pertaining to the end of American combat involvement in Indochina. A supplement takes account of the surrender of South Vietnam in spring 1975. Contributors to the volume—lawyers, scholars, and government officials—include Dean Rusk, Eugene V. Rostow, Richard A. Falk, John Norton Moore, and Richard Wasserstrom. Originally published in 1976. Book excerpt: This is the fourth volume of the "Hague Yearbook of International Law," which succeeds the Yearbook of the Association of Attenders and Alumni of the Hague Academy of International Law. The title "Hague Yearbook of International Law" reflects the close ties which have always existed between the AAA and the City of The Hague with its international law institutions and indicated the Editors' Intention to devote attention to developments taking place in those international law institutions, viz. the International Court of Justice, the Permanent Court of Arbitration, the Iran-United States Claims Tribunal and the Hague Conference on Private International Law. This volume contains in-depth articles on these developments and summaries of (aspects of) decisions rendered by the International Court of Justice, the Permanent Court of Arbitration and the Iran-United States Claims Tribunal. In addition, the 1991 volume contains the papers of the Thirty-fourth AAA Congress held in Montreal on "Regional Economic Integration" and "Property Rights in International Law."

Available in PDF, EPUB and Kindle. Book excerpt: This work presents an in-depth analysis of the most complex of the many ocean boundary delimitation problems confronting neighboring states in the Pacific region. In each case the various factors influencing the parties to the dispute are examined in detail & alternative diplomatic options are compared. Special emphasis is given to the problems of Southeast Asia, East Asia, & the Northeast Pacific, but regional developments in the Southwest Pacific & the Central & Southeast Pacific are also discussed. The authors, who are prominent specialists in the field of ocean policy studies place their factor-and-option analysis of these difficult disputes within a multidisciplinary, 'functionalist' framework, & offer some original proposals for innovative ocean diplomacy that now seem realistic in light of recent improvements in the international political arena.

Book excerpt: Prior to the progressive development of the law of armed conflict heralded by the 1949 Geneva Conventions — most particularly in relation to the concepts of international and non-international armed conflict-the customary doctrine on recognition of belligerency functioned for almost 200 years as the definitive legal scheme for differentiating internal conflict from "civil wars", in which the law of war as applicable between states applied de jure. Employing a legal historical approach, this book describes the thematic and practical fundamentals of the doctrine, and analyzes some of the more significant challenges to its application. In doing so, it assesses whether, how, and why the doctrine on recognition of belligerency was considered "fit for purpose," and seeks to inform debate as to its continuity and utility within the modern scheme of the law of armed conflict.

Available in PDF, EPUB and Kindle. Book excerpt: The war of June 1967 between Israel and Arab states was widely perceived as being forced on Israel to prevent the annihilation of its people by Arab armies hovering on its borders. Documents now declassified by key governments question this view. The UK, USSR, France and the USA all knew that the Arab states were not in attack mode and tried to dissuade Israel from attacking. In later years, this war was held up as a precedent allowing an attack on a state that is expected to attack. It has even been used to justify a pre-emptive assault on a state expected to attack well in the future. Given the lack of evidence that it was waged by Israel in anticipation of an attack by Arab states, the 1967 war can no longer serve as such a precedent. This book seeks to provide a corrective on the June 1967 war.

Available in PDF, EPUB and Kindle. Book excerpt: Annotation Like its predecessor, this important new work is focused on the connection between trade and investment on the one hand and U.S. foreign policy on the other. David Pletcher describes the trade of the United States with the Far East, the islands of the Pacific, and the northwest coast of North America from 1784 (the year of the first American trading expedition to China) to 1844 (the year of the first trade treaty with China, followed immediately by the U.S. acquisition of Oregon and California). He then traces the growth of trade and investment in Alaska, Hawaii, and the South Pacific from 1844 to 1890 and proceeds to do the same for China, Japan, and Korea. In the ensuing chapters, Pletcher covers the 1890s, including the annexation of Hawaii, the Sino-Japanese War, the acquisition of the Philippines, and the Open Door policy in China. He concludes that the American expansion across the Pacific and into the Far East was not a deliberate, consistent drive for economic hegemony but a halting, experimental, improvised movement, carried out against determined opposition and indifference and dotted with setbacks and failures. Providing his own judgments about the wisdom and effectiveness of America's new endeavors, Pletcher summarizes the problems and handicaps involved, demonstrating that errors of the twentieth century were at least partly the result of poor preparation in the 1880s and 1890s. Touching on every place where Americans undertook significant economic activity, The Diplomacy of Involvementwill be an important aid for seasoned scholars, as well as an excellent introduction for the novice

Available in PDF, EPUB and Kindle. Book excerpt: This insightful book explores the acute challenges presented by the .internationalisation. of law, a trend that has been accelerated by the growing requirement for academics and practitioners to work and research across countries and regions with differing legal traditions. The authors have all confronted these challenges of internationalisation throughtheir extensive knowledge and experience in civil law, common law and mixed jurisdictions around the globe. Their analysis of the implications for researchers and teachers, as well as practitioners, law-makers and reformers is original andtheir different proposals for dealing with the challenges are both practical and at times, radical.
