Es soll in dieser Arbeit einleitend um die Grundlagen der gesetzlichen und gewillkürten Erbfolge gehen. Außerdem werden die Testierfreiheit sowie die Erbschaftsteuer behandelt. Auf dieser Basis soll im Anschluss diskutiert werden, welche Bedeutung die juristische Dimension Erbrecht für soziale Ordnung hat. Der Gerechtigkeitsbegriff soll durch die verschiedenen Verteilungsprinzipien der Autoren Liebig et al. greifbar gemacht werden. Im Anschluss daran wird auf die Gerechtigkeitstheorie von John Rawls Bezug genommen, diese in einem kurzen Überblick dargestellt, um im späteren Verlauf seine Gerechtigkeitsprinzipien auf das Erbrecht zu prüfen. Daraufhin soll die Kritik Amartya Sens an Rawls Theorie aufgenommen werden und im Hinblick auf die Bezüge zwischen Rawls Theorie und dem Erbrecht eingefügt werden. Eine der zentralen Aufgaben eines Staates gegenüber seinen Bürger*innen ist es für gerechte Lebensbedingungen innerhalb der Gesellschaft zu sorgen. Ein kurzer Blick auf die Disparitäten der Gesellschaft genügt jedoch, um zu vermuten, dass dessen Durchsetzung häufig nicht der Fall ist. Gerechtigkeit wird auf verschiedenen Gesellschaftsebenen bewertet. Es bestehen Gerechtigkeitsverständnisse innerhalb zwischenmenschlicher Beziehungen auf der Mikro- Ebene, genauso wie auf der Makro-Ebene zwischen Gesellschaft und Staat. Das Erbrecht eröffnet einen soziologischen Gerechtigkeitsdiskurs, der beide Ebenen verbindet. Vor dem Hintergrund der gesellschaftlichen Kräfteverhältnisse, die das Erbrecht freilässt, erklärt sich die Relevanz des Erbrechts als Untersuchungsgegenstand der Soziologie.
