In The Making of Environmental Law, Richard J. Book excerpt: "In the past, environmental legislation has followed a pattern in which individual statutes are periodically revisited for reauthorization and amendment. In the 103rd Congress, after prolonged legislative efforts focused especially on the Clean Water Act, Safe Drinking Water Act, Superfund, and Magnuson Fishery Conservation and Management Act, none of the environmental protection statutes for which authorizations had expired was reauthorized or amended. Even as environmental protection advocates have been urging several initiatives, such as addressing nonpoint sources of water pollution, dealing with environmental justice issues, and fostering ecosystem management, many environmental stakeholders have been raising concerns about regulatory costs, inflexibility, and excessive stringency. These concerns about environmental regulation have led to a series of reform proposals that would require risk- and cost-benefit analyses of regulatory proposals; bar ''unfunded mandates''; and address ''takings, '' regulatory actions considered to infringe on private property rights. While not uniquely environmental, these initiatives were pivotal in blocking much proposed environmental legislation in the 103rd Congress. They can be expected to gain momentum in the 104th Congress. The 104th Congress may pursue environmental and regulatory reform initiatives on two tracks. On one track, the reauthorization and amendment process in the 104th Congress may again proceed as a series of largely independent, statute-specific efforts. Early speculation is that the Safe Drinking Water Act and Superfund will be the first environmental priorities. On this track, regulatory reform could materialize as proposed amendments to the individual statutes. On the other track, the regulatory relief effort could move forward as one or more cross-cutting initiatives. Giving impetus to the latter is the House Republican ''Contract with America'' -- 10 bills to be considered during the first 100 days of the 104th Congress -- which includes several regulatory relief proposals. If general regulatory reform bills were enacted, debates on statute-specific reauthorizations could shift from regulatory reforms to the substantive regulatory requirements of each Act. In this case, regulatory reform could consist of proposals to modify statutory requirements to reduce costs to the private sector and State and local governments, to increase flexibility, and to reduce or compensate regulatory impacts on the value of private property. At issue would be a series of potential tradeoffs, for example among efficiency of environmental regulations, national consistency versus local flexibility, protection of private property rights, and degrees of health and environmental protection.
