Book excerpt: The 2002 issue of the Yearbook concerns the notion of reasonableness in philosohical, legal and economic domains. With regard to legal field, the notion of reasonableness is a core notion in constitutional law and it assumes specific meanings in private, criminal, international, and administrative law. Reasonableness turns out to be crucial with regard to many topics, such as interpretation of rights, balancing of fundamental rights, and interpretation of standards.

Book Synopsis Routledge Handbook of Law and Society in Latin America by : Rachel Sieder
Download or read book Routledge Handbook of Law and Society in Latin America written by Rachel Sieder and published by Routledge. This book was released on 2019-05-20 with total page 1037 pages. Available in PDF, EPUB and Kindle. Book excerpt: An understanding of law and its efficacy in Latin America demands concepts distinct from the hegemonic notions of "rule of law" which have dominated debates on law, politics and society, and that recognize the diversity of situations and contexts characterizing the region. The Routledge Handbook of Law and Society in Latin America presents cutting-edge analysis of the central theoretical and applied areas of enquiry in socio-legal studies in the region by leading figures in the study of law and society from Latin America, North America and Europe. Contributors argue that scholarship about Latin America has made vital contributions to longstanding and emerging theoretical and methodological debates on the relationship between law and society. Key topics examined include: The gap between law-on-the-books and law in action The implications of legal pluralism and legal globalization The legacies of experiences of transitional justice Emerging forms of socio-legal and political mobilization Debates concerning the relationship between the legal and the illegal. The Routledge Handbook of Law and Society in Latin America sets out new research agendas for cross-disciplinary socio-legal studies and will be of interest to those studying law, sociology of law, comparative Latin American politics, legal anthropology and development studies.

Download or read book Liquid Relations written by Dik Roth and published by Rutgers University Press. This book was released on 2005-11-29 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: Water management plays an increasingly critical role in national and international policy agendas. Growing scarcity, overuse, and pollution, combined with burgeoning demand, have made socio-political and economic conflicts almost unavoidable. Proposals to address water shortages are usually based on two key assumptions: (1) water is a commodity that can be bought and sold and (2) “states,” or other centralized entities, should control access to water. Liquid Relations criticizes these assumptions from a socio-legal perspective. Eleven case studies examine laws, distribution, and irrigation in regions around the world, including the United States, Nepal, Indonesia, Chile, Ecuador, India, and South Africa. In each case, problems are shown to be both ecological and human-made. The essays also consider the ways that gender, ethnicity, and class differences influence water rights and control. In the concluding chapter, the editors draw on the essays’ findings to offer an alternative approach to water rights and water governance issues. By showing how issues like water scarcity and competition are embedded in specific resource use and management histories, this volume highlights the need for analyses and solutions that are context-specific rather than universal.
Book Synopsis Water, Power and Identity by : Rutgerd Boelens
Download or read book Water, Power and Identity written by Rutgerd Boelens and published by Routledge. This book was released on 2015-04-10 with total page 389 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book addresses two major issues in natural resource management and political ecology: the complex conflicting relationship between communities managing water on the ground and national/global policy-making institutions and elites; and how grassroots defend against encroachment, question the self-evidence of State-/market-based water governance, and confront coercive and participatory boundary policing (‘normal’ vs. ‘abnormal’). The book examines grassroots building of multi-layered water-rights territories, and State, market and expert networks’ vigorous efforts to reshape these water societies in their own image – seizing resources and/or aligning users, identities and rights systems within dominant frameworks. Distributive and cultural politics entwine. It is shown that attempts to modernize and normalize users through universalized water culture, ‘rational water use’ and de-politicized interventions deepen water security problems rather than alleviating them. However, social struggles negotiate and enforce water rights. User collectives challenge imposed water rights and identities, constructing new ones to strategically acquire water control autonomy and re-moralize their waterscapes. The author shows that battles for material control include the right to culturally define and politically organize water rights and territories. Andean illustrations from Peru, Ecuador, Bolivia and Chile, from peasant-indigenous life stories to international policy-making, highlight open and subsurface hydro-social networks. They reveal how water justice struggles are political projects against indifference, and that engaging in re-distributive policies and defying ‘truth politics,’ extends context-particular water rights definitions and governance forms.
Book Synopsis Witnessing Peace by : Janna L. Hunter-Bowman
Download or read book Witnessing Peace written by Janna L. Hunter-Bowman and published by Taylor & Francis. This book was released on 2022-07-21 with total page 263 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book, rooted in the disciplines of theology and peace studies, reflects with and on war-affected communities in Colombia about transitioning from violence to peace. It argues that much that is significant for peace- building in situations of war escapes the notice of governments, human rights organizations, and academics because it is accomplished through a kind of agency they do not recognize. This book names that agency as constructive agency under duress and demonstrates its significance for peacebuilding by reflecting on a form that the author has seen operating in Colombia over nearly two decades.
