Book excerpt: Die Anwendung des kartellrechtlichen Verbots des Marktmachtmissbrauchs nach Art 102 AEUV auf digitale Plattformen wirft eine Vielzahl dogmatischer Probleme auf. Mehrseitige Plattformmärkte sind durch indirekte Netzwerkeffekte geprägt, welche zu Preisanomalien und damit zur eingeschränkten Anwendbarkeit von ökonometrischen Methoden führen. Zu untersuchen ist daher die kartellrechtliche Marktabgrenzung für Plattformen und deren Implikation für die Beurteilung des Tatbestandsmerkmals der marktbeherrschenden Stellung. Es sollen die Fallgruppe der Geschäftsverweigerung (Essential-Facility-Doktrin) und der Koppelung, welche jeweils einen Marktmachttransfer bedingen können, beleuchtet werden. Im Kontext der digital economy wurden diese in besonderem Maße diskutiert. Ziel der Dissertation ist somit eine Analyse, inwiefern die Spezifika von digitalen Plattformmärkten eine Modifikation dieser Fallgruppen notwendig machen.
