Book excerpt: Excerpt from Depreciation of Public Utility Properties: And Its Relation to Fair Value and Changes in the Level of Prices The regulation of public utilities in the United States is a development of recent years and is still in the period of formation and establishment of rules of practice. The great war, with its unsettling of business conditions, and the violent price fluctuations which accompanied and followed the actual war period have introduced new complications into some of the problems which were being dealt with by Regulating Commissions and Courts just at a time when it appeared that definite conclusions were being reached. Valuation and Depreciation, and the accounting methods which deal with these subjects, have been greatly complicated by the price fluctuations of the period 1914 to 1921. New questions have been raised, new arguments have been introduced and it would appear that some conclusions are in danger of being reached which may have a far reaching effect upon utility properties through the weakening of the stability of valuations already established, and the ultimate wiping out of a large part of the actual investments necessarily made in extensions of property during the period of high prices. A comprehensive treatment of this subject requires the combined knowledge of the engineer, the economist and the lawyer. The following pages, written by an engineer, cannot be offered as an authoritative discussion of the legal questions involved. On the other hand the engineer, who is called upon to prepare and present most of the figures required by courts and commissions as evidence of the value of the property of such undertakings, must have a sufficient knowledge of the legal questions that are at issue to enable him to obtain properly and intelligently the figures needed by the tribunals whose duty it is to assign the fair present value. This must be offered in explanation of the many quotations from decisions of courts and commissions which have been incorporated in the present volume. It has seemed to many who have studied this subject that the precedents are diverse and that much must yet be done before the fair present value of the property of public utilities can be defined. It is a question whether general rules can ever be laid down as to what the fair present value will be in all cases. It would seem as if such value must always be determined by "the well instructed judgment" of a broad minded and impartial tribunal. Book excerpt: The right of the state to control the rates charged by public utilities for service rendered to the public utilities for service rendered to the public is generally accepted by the American courts and by the people at large. Whether or not the utilities themselves approve of government regulation does not materially affect the principle. In a series of important cases, Smyth vs. Ames (1898), Knoxville vs. Knoxville Water Company 91909), Minnesota Rate cases (1913), and Des Moines Gas Company vs. City of Des Moines (1915), the Supreme Court of the land laid down the rule that a public utility is entitled to a reasonable return upon a fair value of the property. This fair value is to be based upon reproduction cost new less accrued depreciation, and the return is to be in addition to an annual allowance sufficient to maintain unimpaired the value of the property. How much depreciation or upon what basis the accrued depreciation and the annual allowance should be estimated, the Court did not say. This problem has been left to state legislatures, courts, and commissions to solve, with occasional opinions voiced by the United States Supreme Court when cases are appealed to that body to determine whether or not rates fixed result in a confiscation of property without due process of law. The Court has not answered any of the perplexing questions that have troubled the regulating commissions but has merely required that the rates fixed be high enough, however calculated, to provide a reasonable return upon a fair value of the property.
