Book excerpt: Article 18 of the Vienna Convention on the Law of Treaties (VCLT) plays an indispensable role in promoting stable relations amongst States by obliging them to refrain from acts which would defeat the object and purpose of pending treaties. However, for more than 50 years since its adoption, Article 18 has lingered in a state of legal uncertainty. This book offers a complete guide to the precise scope and content of Article 18 VCLT by analysing its particular elements. Of relevance to scholars, practitioners, and postgraduate students of international law, it applies Article 18 VCLT to contemporary events in international law. It showcases the vitality and direct relevance of the provision in today’s international legal order, while offering concrete arguments for its effective application.

Available in PDF, EPUB and Kindle. Book excerpt: In 1865, Wild Bill Hickok killed Dave Tutt in a Missouri public square in the West’s first notable "walkdown." One hundred and twenty-nine years later, Bernard Goetz shot four threatening young men in a New York subway car. Apart from gunfire, what do the two events have in common? Goetz, writes Richard Maxwell Brown, was acquitted of wrongdoing in the spirit of a uniquely American view of self-defense, a view forged in frontier gunfights like Hickok’s. When faced with a deadly threat, we have the right to stand our ground and fight. We have no duty to retreat.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the impact of rumour during the French Revolution, offering a new approach to understanding the experiences of those who lived through it. Focusing on Paris during the most radical years of the Jacobin republic, it argues that popular rumour helped to shape perceptions of the Revolution and provided communities with a framework with which to interpret an unstable world. Lindsay Porter explores the role of rumour as a phenomenon in itself, investigating the way in which the informal authority of the ‘word on the street’ was subject to a range of historical and contemporary prejudices. Drawing its conclusions from police reports and other archival sources, this study examines the potential of rumour both to unite and to divide communities, as rumour and hearsay began to play an important role in defining and judging personal commitment to the Revolution and what it meant to be a citizen.

Book excerpt: This ebook is the best-known work of Thomas Aquinas (c.1225–1274). Although unfinished, the Summa is "one of the classics of the history of philosophy and one of the most influential works of Western literature." It is intended as an instructional guide for moderate theologians, and a compendium of all of the main theological teachings of the Catholic Church. It presents the reasoning for almost all points of Christian theology in the West. The Summa Theologica is divided into three parts, and each of these three parts contains numerous subdivisions. Part 1 deals primarily with God and comprises discussions of 119 questions concerning the existence and nature of God, the Creation, angels, the work of the six days of Creation, the essence and nature of man, and divine government. Part 2 deals with man and includes discussions of 303 questions concerning the purpose of man, habits, types of law, vices and virtues, prudence and justice, fortitude and temperance, graces, and the religious versus the secular life. Part 3 deals with Christ and comprises discussions of 90 questions concerning the Incarnation, the Sacraments, and the Resurrection. Some editions of the Summa Theologica include a Supplement comprising discussions of an additional 99 questions concerning a wide variety of loosely related issues such as excommunication, indulgences, confession, marriage, purgatory, and the relations of the saints toward the damned. Scholars believe that Rainaldo da Piperno, a friend of Aquinas, probably gathered the material in this supplement from a work that Aquinas had completed before he began working on the Summa Theologica.

Available in PDF, EPUB and Kindle. Book excerpt: First Published in 1998, this book presents an analysis of international humanitarian law, the law governing and seeking to mitigate the conduct of armed conflict. Since the first edition of this work came out in 1990 there have been important developments in the law and, sadly, a continuing experience of armed conflict and the humanitarian crises which it represents. As a result, this is not so much an ‘updating’ as the offering of a new book. International humanitarian law is here taken as coterminous with the jus in bello and covers both its ‘Geneva’ and ‘Hague’ elements dealing, respectively with the humanitarian protection and assistance of victims of armed conflict and the controls and restrictions placed upon methods and means of warfare. The rules and principles of international humanitarian law are presented and analysed in the context of their practical application in warfare, with emphasis upon recent experience. The Work is Primarily dedicated to the law relating to international armed conflict but also includes discussion of the relevant law applicable to non-international and ‘low level’ conflict.

Book excerpt: Marking the 50th anniversary of the influential ERTA doctrine, this book analyses and contextualises the entire breadth of the jurisprudence of EU external relations law through a systematic, case-by-case account of the field. The entire framework of EU external relations law has been built from the ground up by the jurisprudence of the Court of Justice of the European Union. At the beginning of the field's emergence, the legal questions to be answered concerned the division of powers and competence between, firstly, the Member States and that of the Union; and secondly, the division of powers and competence between the different institutions of the Union. Questions on such matters continue to be asked, but more contemporarily, new legal questions have arisen that have been in need of adjudication, including questions concerning the autonomy of Union law; the relationship between the Union and other international organisations; the relationship between Union law and international law; the scope and breadth of international agreements; amongst others. The book features established academic scholars, judges, agents of institutions and Member States, and legal practitioners in the field of EU external relations law, analysing over 90 cases in which the Court has legally shaped the theory and practice of the external dimension of legal Europe.
