Book excerpt: El presente libro reúne las ponencias presentadas en las Jornadas "El urbanismo de la crisis: la regularización de las edificaciones ilegales y el régimen de asimilación a fuera de ordenación" celebradas en la Facultad de Derecho de Sevilla, el viernes 7 de noviembre de 2014 organizadas por el Grupo de investigación Urbanismo y Ordenación del Territorio en Tiempos de Crisis (P11-SEJ-7758), Proyecto de Excelencia de la Junta de Andalucía, con la colaboración del Instituto Universitario de Investigación García Oviedo, que se celebraron con intensa participación de más de 140 asistentes (Letrados, Inspectores, funcionarios y personal al servicio de las Administraciones). El principio "conforme a plan" es una de las esencias del Derecho urbanístico. En nuestro ordenamiento jurídico desde 1956, la legislación urbanística se apoya en la idea central del planeamiento como instrumento jurídico para la ordenación de la ciudad e instrumento técnico de concreción espacial y temporal del estatuto del derecho de propiedad. El Plan, como "anti-azar" es la herramienta central escogida por la ley para determinar el crecimiento posible, el diseño de la ciudad, los sistemas generales y dotaciones (Estado Social) y delimitar el contenido patrimonial del derecho a la propiedad urbana (derecho de propiedad). Pero la realidad escapa a este principio ideal y es necesario dar respuesta a lo construido al margen del plan. La edificación irregular constituye un problema jurídico y social de primer orden. En los últimos tiempos sendas iniciativas normativas intentan solucionar en la Comunidad Autónoma de Andalucía la problemática creada por este fenómeno.

Book excerpt: RESUMEN El Estado español tiene más de 100.000 construcciones ilegales. En la actualidad, la ejecución de las sentencias en materia urbanística no es eficaz. Existe, por tanto, una situación de inejecución de las sentencias urbanísticas. Un ciudadano puede construir una casa al amparo de una licencia. Sin embargo, a veces, esta licencia es ilegal porque infringe el plan urbanístico aplicable y incluso la propia ley de urbanismo. La consecuencia jurídica de la ilegal es la obligatoriedad del derribo de lo ilegalmente construido. Lo mismo sucede ante la declaración de ilegalidad de un plan urbanístico. En este caso, el juez o tribunal estimará la ilegalidad del plan y el fallo deberá ser ejecutado. La solución no es un fácil porque la demolición o derribo de la construcción ilegal trae consigo el pago de una indemnización a los propietarios que han edificado al amparo de una licencia ilegal. El derecho a la ejecución de sentencias es prescrito por el artículo 24 de la Constitución española. Este artículo 24 garantiza el derecho de todos ciudadanos a una tutela judicial efectiva. El Tribunal Constitucional español en sus sentencias número 67/1984 y 28/1989, reconocieron que el derecho a la ejecución de las resoluciones judiciales deriva del propio derecho a la tutela judicial efectiva. La justicia administrativa está regulada por la Ley 29/1998, del 13 de julio, reguladora de la jurisdicción contencioso-administrativa. En su artículo 103.1 de la Ley 29/1998, establece que los jueces y los tribunales de la jurisdicción administrativa son los competentes para hacer ejecutar las sentencias. Por otro lado, el artículo 117.3 de la Constitución Española otorga la competencia en exclusiva a los jueces y tribunales para hacer ejecutar las sentencias, como manifestación del principio de división de poderes. En último lugar, los valores que la legislación urbanística española incorpora, tales como, el desarrollo sostenible, urbanismo sostenible y la cohesión social, quedan inaplic.

It saw extreme violence on both sides, including the terrorizing and targeting of civilians by death squads, recruitment of child soldiers, and the death and disappearance of more than 75,000 people. Examining El Salvador's vibrant life-story literature written in the aftermath of this terrible conflict--including memoirs and testimonials--Erik Ching seeks to understand how the war has come to be remembered and rebattled by Salvadorans and what that means for their society today. Ching identifies four memory communities that dominate national postwar views: civilian elites, military officers, guerrilla commanders, and working class and poor testimonialists. Pushing distinct and divergent stories, these groups are today engaged in what Ching terms a "narrative battle" for control over the memory of the war. Their ongoing publications in the marketplace of ideas tend to direct Salvadorans' attempts to negotiate the war's meaning and legacy, and Ching suggests that a more open, coordinated reconciliation process is needed in this postconflict society. In the meantime, El Salvador, fractured by conflicting interpretations of its national trauma, is hindered in dealing with the immediate problems posed by the nexus of neoliberalism, gang violence, and outmigration.

Book excerpt: While indigenous languages have become prominent in global political and educational discourses, limited attention has been given to indigenous children’s everyday communication. Voices of Play is a study of multilingual play and performance among Miskitu children growing up on Corn Island, part of a multi-ethnic autonomous region on the Atlantic Coast of Nicaragua. Corn Island is historically home to Afro-Caribbean Creole people, but increasing numbers of Miskitu people began moving there from the mainland during the Contra War, and many Spanish-speaking mestizos from western Nicaragua have also settled there. Miskitu kids on Corn Island often gain some competence speaking Miskitu, Spanish, and Kriol English. As the children of migrants and the first generation of their families to grow up with television, they develop creative forms of expression that combine languages and genres, shaping intercultural senses of belonging. Voices of Play is the first ethnography to focus on the interaction between music and language in children’s discourse. Minks skillfully weaves together Latin American, North American, and European theories of culture and communication, creating a transdisciplinary dialogue that moves across intellectual geographies. Her analysis shows how music and language involve a wide range of communicative resources that create new forms of belonging and enable dialogue across differences. Miskitu children’s voices reveal the intertwining of speech and song, the emergence of “self” and “other,” and the centrality of aesthetics to social struggle.

Book excerpt: Inalienable Possessions tests anthropology's traditional assumptions about kinship, economics, power, and gender in an exciting challenge to accepted theories of reciprocity and marriage exchange. Focusing on Oceania societies from Polynesia to Papua New Guinea and including Australian Aborigine groups, Annette Weiner investigates the category of possessions that must not be given or, if they are circulated, must return finally to the giver. Reciprocity, she says, is only the superficial aspect of exchange, which overlays much more politically powerful strategies of "keeping-while-giving." The idea of keeping-while-giving places women at the heart of the political process, however much that process may vary in different societies, for women possess a wealth of their own that gives them power. Power is intimately involved in cultural reproduction, and Weiner describes the location of power in each society, showing how the degree of control over the production and distribution of cloth wealth coincides with women's rank and the development of hierarchy in the community. Other inalienable possessions, whether material objects, landed property, ancestral myths, or sacred knowledge, bestow social identity and rank as well. Calling attention to their presence in Western history, Weiner points out that her formulations are not limited to Oceania. The paradox of keeping-while-giving is a concept certain to influence future developments in ethnography and the theoretical study of gender and exchange.
