Professor O'Donnell begins by arguing that conceptions of 'the state' and 'democracy', and their respective defining features, significantly influence each other. Using an approach that is both historical and analytical, he traces this relationship through the idea of legally sanctioned and backed agency which grounds democratic citizenship. From this standpoint he explores several aspects of the democratic regime and of the state, distinguishing four constitutive dimensions (bureaucracy, legality, focus of collective identity, and filter). He goes on to examine the role played by the idea of 'the nation' or 'the people', and the ways in which the state represents itself to different sections of society, especially in countries marred by deep inequality and pervasive poverty. Drawing on the examples of democratic and non-democratic regime, he discusses the dialogical spaces congenial to democracy, as well as examining the options that may or may not enable agency, and the complex comparative and ethical issues raised by the intersection of agency with globalization and legal pluralism.Throughout these discussions several comparative vistas are opened, especially but not exclusively toward Latin America. The book concludes by offering a justification of democracy, even of the flawed democracies that nowadays abound. The vague and sometimes conflicting policy mandates of Congress, the president, and courts are translated into real public policy in the bureaucracy. As the role of the national government has expanded, the national legislature and executive have increasingly delegated authority to administrative agencies to make fundamental policy decisions. How this administrative state is designed, its coherence, its responsiveness, and its efficacy determine, in Robert Dahl’s phrase, “who gets what, when, and how.” This study of agency design, thus, has implications for the study of politics in many areas. The structure of bureaucracies can determine the degree to which political actors can change the direction of agency policy. Politicians frequently attempt to lock their policy preferences into place through insulating structures that are mandated by statute or executive decree. This insulation of public bureaucracies such as the National Transportation Safety Board, the Federal Election Commission, and the National Nuclear Security Administration, is essential to understanding both administrative policy outputs and executive-legislative politics in the United States. This book explains why, when, and how political actors create administrative agencies in such a way as to insulate them from political control, particularly presidential control.

Historically, the state has played a crucial role as enforcer of liberal democratic constitutions, but it has also been used by autocratic rulers to entrench their rule. The state is thus a two-edged sword: It can both be the guarantee of democratic rights and a tool that can be used to suppress such rights. One corollary of this is that the influence of state structures on democratic development depends on who holds government power. But the opposite observation can also be made, as governments play an important role in shaping the state apparatus. The state and the regime are thus intertwined. Against this backdrop, this book presents a series of attempts – authored by influential experts such as Francis Fukuyama and Gerardo Munck – to disentangle the relationship between the state and political regimes. The contributions differ in terms of their particular theoretical and empirical focus. But they share the assumption that three criteria need to be observed to achieve a better understanding of the state-democracy nexus. First, it is valuable to distinguish conceptually between different aspects of the state. Second, the potential relationships between democracy and these attributes of state should be carefully theorized. Third, the consequent propositions must be interrogated using comparative approaches. This book was originally published as a special issue of Democratization.
