Seg?n esta ley, consumidor o usuario es toda persona f?sica o jur?dica que adquiere, utiliza o disfruta como destinatario final de cualquier bien, producto o servicio. No es consumidor o usuario quien adquiera, almacene, utilice o consuma bienes o servicios con el fin de integrarlos en procesos de producci?n, transformaci?n, comercializaci?n o prestaci?n a terceros, es decir, sin ser los destinatarios finales. Los derechos b?sicos de los consumidores que establece esta norma son: a) Derecho a la protecci?n de la salud y la seguridad. Los productos y servicios puestos a disposici?n de los consumidores o usuarios no implicar?n riesgos para su salud o seguridad, excepto los usuales que provengan de una utilizaci?n previsible en condiciones normales del producto o servicio. Los consumidores o usuarios deben estar correctamente informados de los riesgos derivados del uso normal de productos o servicios, as? como de su forma de evitarlos. b) Derecho a la protecci?n de los intereses econ?micos y sociales. La ley protege al consumidor o usuario de los posibles abusos por parte del vendedor. La publicidad se ajustar? a las caracter?sticas del producto y no podr? ser falsa o enga?osa. Los contratos deber?n estar redactados de forma clara y sencilla y no han de contener cl?usulas abusivas o lesivas para el consumidor. c) Derecho a la informaci?n. Los productos o servicios puestos a disposici?n de consumidores y usuarios deber?n proporcionar una informaci?n veraz y suficiente sobre sus caracter?sticas esenciales: naturaleza, composici?n, aditivos autorizados, calidad, cantidad, categor?a, precio, fecha de producci?n, fecha de caducidad, instrucciones para su correcto uso, etc. d) Derecho a la educaci?n y formaci?n. El consumidor o usuario tiene derecho a estar formado e informado en materia de consumo, para que pueda as? actuar con mayor libertad y racionalidad a la hora de la de compra o uso de bienes o servicios. Tambi?n debe tener f?cil acceso al conocimiento de sus derechos y responsabilidades. e) Derecho de representaci?n, consulta y participaci?n. Con el objetivo de defender sus derechos e intereses, los consumidores y usuarios tienen derecho a constituirse en asociaciones de consumidores con arreglo a la Ley de Asociaciones. ?stas deber?n se consultadas antes de elaborar disposiciones sobre materias que afecten directamente a los consumidores o usuarios. f) Derecho a ser protegido ante situaciones de inferioridad, subordinaci?n o indefensi?n. En las ocasiones en que el consumidor o usuario se encuentre en situaciones de inferioridad, subordinaci?n o indefensi?n respecto del vendedor o proveedor, los poderes p?blicos adoptar?n las medidas adecuadas para suplir o equilibrar estas situaciones. g) Derecho a la indemnizaci?n por da?os y perjuicios. El consumidor o usuario tiene derecho a ser indemnizado por los da?os y perjuicios derivados del consumo de bienes y servicios defectuosos. El sistema arbitral de consumo agiliza los tr?mites y abarata los costes del proceso que se ha de seguir para poder cobrar estas indemnizaciones.

Through the technique of validity, lawyerly reasoning settles morally pressing matters in a way that largely bypasses moral argument. Legal philosophy has paid considerable attention to validity criteria, but it has neglected to explore validity's point: whether, and if so how, the pervasive technique of validity can contribute to a legal system's ability to realise justice and human rights. This book shows that validity can help a political community to foster justice precisely because validity does not primarily turn on moral considerations. Validity serves to both allocate, and limit, a distinct kind of power, a power that is key to forging valuable forms of enterprise and commitment in pursuit of individual and collective self-direction.
