Book excerpt: The objective of this decentralization study is to provide analysis and policy advice to the new Malagasy government on how to proceed with the decentralization strategy it inherited from the previous government. The end of the post-crisis emergency recovery period creates the opportunity to correct the weaknesses of the previous strategy while building on the exiting achievements. The paper specifically aims to (i) analyze the institutional and fiscal context of decentralization and (ii) present the resulting challenges for service delivery and financing - with a particular focus on local governments. Benefiting from primary data from several hundred local governments, this study aims at proving recommendations of how to improve the functioning of communes in considering the institutional and fiscal parameters. The report is organized into four chapters, including the Introduction, which explain the political, institutional, and fiscal determinants that have been influencing Madagascar's decentralization process, and which will continue to do so in the future. Chapter 2 provides the political and institutional background needed to better understand the decentralization context of today. The chapter analyzes the historical forces of centralization, which date back to pre-colonial times and translate into today's dominant role of the central government administration. The chapter then takes a closer look at the existing administrative set-up to explain functions and responsibilities at different levels of government. To this end, it looks at the regulatory gaps and inconsistencies in the legal framework, the parallelism between decentralized and deconcentrated layers, and the emerging role of inter- communal associations and informal regional planning bodies. Based on the concept of the sub-national fiscal gap, chapter 3 analyzes structural constraints to fiscal decentralization in Madagascar, and in particular the dominance of revenue items which cannot be decentralized. Given the l o w degree of fiscal decentralization, the chapter takes a closer look at expenditure deconcentration and provides a more in-depth analysis of deconcentration in the health and education sectors. The last part of the chapter evaluates Madagascar's intergovernmental transfers, which represent the most important source of local government financing. Against this backdrop, this paper seeks to distill the lessons for an effective fiscal decentralization reform, focusing on the macroeconomic aspects. The main findings for sub-Saharan African countries that have decentralized, based on an empirical analysis and four case studies (Kenya, Nigeria, South Africa, Uganda), are as follows: • Determinants and effectiveness: Empirical results suggest that (1) the major driving forces behind fiscal decentralization in sub-Saharan Africa include efforts to defuse ethnic conflicts, the initial level of income, and the urban-ization rate, whereas strength of democracy is not an important determi-nant for decentralization; and (2) decentralization in sub-Saharan Africa is associated with higher growth in the presence of stronger institutions. • Spending assignments: The allocation of spending across levels of gov-ernment in the four case studies is broadly consistent with best practice. However, in Uganda, unlike in the other three case studies, subnational governments have little flexibility to make spending decisions as a result of a deconcentrated rather than a devolved system of government. • Own revenue: The assignment of taxing powers is broadly in line with best practice in the four case studies, with the bulk of subnational revenue coming from property taxes and from fees for local services. However, own revenues are a very small fraction of subnational spending, reflecting weak cadaster systems and a high level of informality in the economy.

This book is a collection of eight papers written by nine authors who were intimately involved in the complex decentralization reform process in Sierra Leone from 2003 07. During this period, Sierra Leone s government established elected district and urban councils across the country, transferred certain responsibilities for primary services and local investment and some financial resources to the new councils, and invested heavily in building the administrative infrastructure and capacity of the local councils. Compared to most other Sub-Saharan African countries that have embarked upon decentralization, Sierra Leone s progress in building local government capacity and restructuring the fiscal system is enviable. The authors conclude that improved security and public services are possible in a decentralizing country and Sierra Leone s progress would not have been possible without significant effort at fiscal decentralization and intensive investment in local government capacity building. The most critical ingredient for this promising but fragile reform process is the dynamic leadership team in charge of promoting the new institutional framework and their persistent effort to achieve quick improvement in the local government system and public services.

Book excerpt: Madagascar’s constitution of August 19, 1992 brought hope to a population exhausted by economic failures associated with a failed experiment in scientific socialism and years of mismanagement. The repetition of transparent elections and the promulgation of “good governance” in the years that followed appeared to serve as an indicator of institutional strengthening and, by extension, progress. Unfortunately, a broader institutional analysis points toward a series of shocks to the political system by way of legal, but highly detrimental, juridical and constitutional shifts to the system. These shocks were meant to serve particularized political networks with long clientalistic roots and were made possible by the narrow vision of institutionalism that did not take careful stock of those networks or the leaders at the top of them. Little effort was made to look beyond a legislature brought in by careful elections but producing legislation serving individuals, the ways in which inchoate political parties distort institutional outcomes and the potential for institutionalization, the weakness of civil society to offer opportunities for popular engagement, or the use of donor-funded decentralization programs to build ministries that served as powerful and rapid proxies for leadership centralization. By the time the celebrated president, Marc Ravalomanana, was overthrown in March 2009 it became clear that there were few opportunities to seed political opposition and such limited space between individual leaders and primary institutions of public management that critical state functions immediately began to unravel. In this book the author considers the institutions of the Third Republic, how they formed, and why they looked like models for democratic change before turning to consider how the institutions themselves have been manipulated in plain sight by leaders looking to champion their own networks. He concludes that the rise of the Fourth Republic in 2010 did little to address these underlying concerns and argues that a new agenda is in order to consider not just the way in which institutions form, but the way in which networks of power, and leaders at the top of those networks, grow and change malleable institutions in young democracies with few avenues of accountability.
