Available in PDF, EPUB and Kindle. Book excerpt: This volume is a systematic study of the rules of proof in English Courts of Equity between the later sixteenth and the early eighteenth century. In this period the proof practices of the Courts of Equity were controversial, as contemporary lawyers saw them as linked to the Civil Law, and some perceived a threat to the Common Law tradition. The reality of this linkage and threat has continued to be controversial among historians. In addition, this period saw the early stages of the development of the Common Law of Evidence, which in modern law is a striking divergence from Civil Law systems. The origins of the law of evidence have traditionally been linked to the need for judges to control the jury, but this view has been subject to several recent critiques. The Courts of Equity did not generally use jury trial. This study considers Equity proof rules in their relationships to contemporary Civil and Canon Law proof conceptions, medieval Common Law rules governing proof of facts, and early Common Law evidence rules. It concludes that Equity courts operated a variant of civilian proof concepts, and mediated an influence of these concepts on the origins of the Common Law of Evidence. These findings cast a new light on the debates on these origins, and on the relationship between the Common Law and Civil Law traditions in early modern England.

Book excerpt: The status of citizen was increasingly the right of the majority in the Roman empire and brought important privileges and exemption from certain forms of punishment. However, not all Roman citizens were equal; for example bastards, freed persons, women, the physically and mentally handicapped, under-25s, ex-criminals and soldiers were subject to restrictions and curtailments on their capacity to act. Being a Roman Citizen examines these forms of limitation and discrimination and thereby throws into sharper focus Roman conceptions of citizenship and society.

Book excerpt: 'Inquisition' was the new form of criminal procedure that was developed by the lawyer-pope Innocent III and given definitive form at the Fourth Lateran Council of 1215. It has since developed a notoriety which has obscured the reality of the procedure, and it is this that Professor Kelly is first concerned with here. In contrast to the old Roman system of relying on a volunteer accuser-prosecutor, who would be punished in case of acquittal, the inquisitorial judge himself served as investigator, accuser, prosecutor, and final judge. A probable-cause requirement and other safeguards were put in place to protect the rights of the defendant, but as time went on some of these defences were modified, abused, or ignored, most notoriously among papally appointed heresy-inquisitors; but in all cases appeal and redress were at least theoretically possible. Unlike continental practice, in England inquisitorial procedure was mainly limited to the local church courts, while on the secular side native procedures developed, most notably a system of multiple investigators/accusers/judges, known collectively as the jury. Private accusers, however, were still to be seen, illustrated here in the final pair of studies on 'appeals' of sexual rape.

Available in PDF, EPUB and Kindle. Book excerpt: The first Symposium consisted of three people in a cafe in Warsaw in 1973. Since then, meetings have grown in size and have been held in Leyden, Copenhagen, Nijmegen, Rome, Oxford, Poitiers and Freiburg am-Breisgau. The ninth Symposium was held in St Andrews in June 1990, with 57 participants who listened to addresses by 28 speakers. It was very fitting that Scotland's oldest university, founded in the heyday of medievalleaming in 1411, should have been given the chance to bring together scholars from all over Europe and beyond to present their researches on the glorious past of scholastic rational thought. The topic of the Symposium was "Sophisms in Medieval Logic and Grammar". The present volume consists, for the most part, of the papers presented at the Symposium. In fact, however, it proved impossible to include five of the contributions. Two of the papers included here were intended for the Symposium but in the event not delivered, because of the unavoidable absence of the speakers. The Symposium received very helpful financial support from one of the major philosophical associations in Britain, the Mind Association, from the Philosophical Quarterly, a journal published at St Andrews, from the University of St Andrews, from the British Academy, and from Low and Bonarplc. In organising the programme for the conference and in preparing the papers for publication I received invaluable help from: Professor E.J.

Book excerpt: The convocation records of the Churches of England and Ireland are the principal source of our information about the administration of those churches from middle ages until modern times. They contain the minutes of clergy synods, the legislation passed by them, tax assessments imposed by the king on the clergy, and accounts of the great debates about religious reformation; they also include records of heresy trials in the fifteenth and sixteenth centuries, many of them connected with the spread of Lollardy. However, they have never before been edited or published in full, and their publication as a complete set of documents provides a valuable resource for scholarship. This volume contains a complete collection of early Manx ecclesiastical statutes and the convocation records, which include the details of the translation of the Bible into Manx. The volume also has a complete list of the Manx clergy arranged both alphabetically and by paris
