Tandis que le projet de loi sur l'indemnisation de l'aléa thérapeutique est encore en attente, chirurgiens et anesthésistes sont soumis quotidiennement à la crainte d'être mis en cause à l'occasion de leurs pratiques. Confrontée en permanence à un double risque, celui de la maladie, et celui du traitement, l'équipe chirurgicale est facilement suspectée de faute lorsque l'accident survient. La faute est en effet encore l'étape obligée pour que le malade obtienne l'indemnisation de son préjudice. L'erreur technique est sévèrement jugée et l'on assiste de plus en plus à de véritables dérives, qui font peser sur les professionnels des obligations difficiles à satisfaire (dérive de la responsabilité en matière d'infections nosocomiales, dérive de l'obligation d'information). Définir la faute dans ces domaines techniques n'est pas chose facile, et on la confond trop souvent avec le risque. L'insuffisance de normalisation des moyens renforce cette difficulté en l'absence de critères clairement établis, comment définir la faute chirurgicale ? La hantise du " médico-légal " a tendance à envahir salles de consultations et blocs opératoires. Cette crainte est-elle justifiée ? quelle est l'étendue réelle de la responsabilité chirurgicale, quelles sont les précautions à prendre pour éviter le procès ? Si les pratiques ne semblent pas encore modifiées par cette menace permanente, un climat délétère s'est insinué dans la relation thérapeutique, et la défiance, tend à remplacer la confiance nécessaire aux patients comme aux praticiens. Comment faire évoluer la responsabilité chirurgicale de manière à rééquilibrer la relation thérapeutique ? Comment recentrer la responsabilité du corps médical sur l'obligation de moyens tout en redonnant confiance à des patients qui réclament plus de transparence et de sécurité ?
