Desse tempo longínquo até os dias atuais, várias foram as fases de desenvolvimento ultrapassadas pelo instituto da responsabilidade civil, passando-se da responsabilidade fundamentada na ideia de dano à responsabilidade civil baseada no risco social gerado. Independentemente da modalidade de responsabilização, uma tônica que se demonstra constante no sistema jurídico brasileiro é a do reequilíbrio patrimonial ideal, devendo aquele que praticou o ato ilícito ressarcir a vítima na totalidade do dano causado. Nessa perspectiva, emergiu uma grande controvérsia doutrinária e jurisprudencial acerca da possibilidade de transmissão de pretensões indenizatórias por dano moral aos herdeiros, quando a vítima vem a falecer. Considerando, notadamente, que o dano moral é algo personalíssimo, e que, em tese, só poderia ser reivindicado pela vítima. Ocupa-se a presente pesquisa, portanto, da transmissibilidade causa mortis do direito à reparação por danos morais, frente ao modelo de responsabilização civil brasileiro. Para clarear o tema, utilizou-se do método dedutivo, empregando a pesquisa bibliográfica em doutrina, análise jurisprudencial e de dispositivos legais aplicáveis, para compor o referencial teórico.
