Book excerpt: A ideia de responsabilizar aquele que atua em desconformidade com aquilo que os membros da comunidade reputam como desejável ou em desapreço ao ideal comum de justiça remonta ao Código de Hamurabi (2.000 a.C.), o qual criou a Lei de Talião e os primeiros esboços do que seria um sistema de ressarcimento civil. Desse tempo longínquo até os dias atuais, várias foram as fases de desenvolvimento ultrapassadas pelo instituto da responsabilidade civil, passando-se da responsabilidade fundamentada na ideia de dano à responsabilidade civil baseada no risco social gerado. Independentemente da modalidade de responsabilização, uma tônica que se demonstra constante no sistema jurídico brasileiro é a do reequilíbrio patrimonial ideal, devendo aquele que praticou o ato ilícito ressarcir a vítima na totalidade do dano causado. Nessa perspectiva, emergiu uma grande controvérsia doutrinária e jurisprudencial acerca da possibilidade de transmissão de pretensões indenizatórias por dano moral aos herdeiros, quando a vítima vem a falecer. Considerando, notadamente, que o dano moral é algo personalíssimo, e que, em tese, só poderia ser reivindicado pela vítima. Ocupa-se a presente pesquisa, portanto, da transmissibilidade causa mortis do direito à reparação por danos morais, frente ao modelo de responsabilização civil brasileiro. Para clarear o tema, utilizou-se do método dedutivo, empregando a pesquisa bibliográfica em doutrina, análise jurisprudencial e de dispositivos legais aplicáveis, para compor o referencial teórico.

There are several reasons for this: the expansion of IPRs beyond their traditional borders, the creation of new IPRs especially at EU level, the exploitation of gaps in the law by shrewd lawyers, and the use of unfair competition as an alternative when IPRs are either not available at all or expired. The convergence of several IPRs on the same subject-matter poses problems. As they are normally envisaged as water-tight categories, there are very few rules which cater for the sort of regime clash that any overlap of IPRs necessarily entails. This book's aim is to find appropriate rules to regulate overlaps and thereby avoid regime conflicts and undue unstructured expansion of IPRs. The book studies the practical consequences of each overlap at the international, European and national levels (where the laws of France, the UK and Germany are reviewed). It then analyses the reasons for the prohibition or authorisation of overlaps. This analysis enables the determination of criteria and principles that can be used to (re)map the overlaps to achieve appropriateness and legitimacy.
