Book Synopsis European Ways of Law by : Volkmar Gessner
Download or read book European Ways of Law written by Volkmar Gessner and published by Bloomsbury Publishing. This book was released on 2007-10-30 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can there be such a thing as a European sociology of law? The uncertainties which arise when attempting to answer that straightforward question are the subject of this book, which also overlaps into comparative law, legal history, and legal philosophy. The richness of approaches reflected in the essays (including comparisons with the US) makes this volume a courageous attempt to show the present state of socio- legal studies in Europe and map directions for its future development. Certainly we already know something about the existence of differences in the use and meaning of law within and between the nation states and groups that make up the European Union. They concern the role of judges and lawyers, the use of courts, patterns of delay, contrasts in penal 'sensibilities', or the meanings of underlying legal and social concepts. Still, similarities in 'legal culture' are at least as remarkable in societies at roughly similar levels of political and economic development. The volume should serve as a needed stimulus to a research agenda aimed at uncovering commonalities and divergences in European ways of approaching the law.

Download or read book Working Law written by Lauren B. Edelman and published by University of Chicago Press. This book was released on 2016-11-28 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the passage of the Civil Rights Act, virtually all companies have antidiscrimination policies in place. Although these policies represent some progress, women and minorities remain underrepresented within the workplace as a whole and even more so when you look at high-level positions. They also tend to be less well paid. How is it that discrimination remains so prevalent in the American workplace despite the widespread adoption of policies designed to prevent it? One reason for the limited success of antidiscrimination policies, argues Lauren B. Edelman, is that the law regulating companies is broad and ambiguous, and managers therefore play a critical role in shaping what it means in daily practice. Often, what results are policies and procedures that are largely symbolic and fail to dispel long-standing patterns of discrimination. Even more troubling, these meanings of the law that evolve within companies tend to eventually make their way back into the legal domain, inconspicuously influencing lawyers for both plaintiffs and defendants and even judges. When courts look to the presence of antidiscrimination policies and personnel manuals to infer fair practices and to the presence of diversity training programs without examining whether these policies are effective in combating discrimination and achieving racial and gender diversity, they wind up condoning practices that deviate considerably from the legal ideals.

Book Synopsis A Political Economy of Power by : Raphaël Fèvre
Download or read book A Political Economy of Power written by Raphaël Fèvre and published by Oxford University Press. This book was released on 2021 with total page 281 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Today, ordoliberalism is at the centre of the ongoing debate about the foundations, the present governance and future prospects of the European Union-and yet we do not dispose of a comprehensive definition of it. Whenever we talk of the dominance of the German model, the discussion should involve a detailed picture of ordoliberal principles. This book retraces the intellectual history of ordoliberalism, focusing in particular on the works of its main representatives Walter Eucken and Wilhelm Röpke, together with references to the contributions of Franz Böhm, Alexander Rüstow, Leonhard Miksch and Friedrich Lutz. The book highlights the crucial, albeit overlooked, role of economic and political power in the making of ordoliberal thought. More precisely, the book shows that ordoliberalism, in its ideological, epistemological, theoretical and political components, can be defined as a political economy of power, i.e. a form of economic knowledge, whose primary objective is to analyse the sources, the action and the impact of power within society. By doing so the book will offer a new perspective on ordoliberals' key concepts built in the inter-war, while contextualizing them within a broader intellectual project"--

Book Synopsis Innovative Business Practices by : Alkis Thrassou
Download or read book Innovative Business Practices written by Alkis Thrassou and published by Cambridge Scholars Publishing. This book was released on 2013-07-16 with total page 403 pages. Available in PDF, EPUB and Kindle. Book excerpt: This second decade of the millennium finds the world changing at a once unimaginable pace. Businesses, tangled in the interwoven threads of galloping globalization, technological advances, cultural diversity, economic recession and deep-rooted human social evolution, struggle to keep up with incessant changes; consequently and inexorably experiencing severe difficulties and disorientation. Executives, much bewildered, habitually turn to conventional, time-honoured strategies and practices, which increasingly fail to offer the much-sought answers and means to survival, competitiveness and growth. We are currently experiencing a business era of turbulence and dynamic change – an era that inherently rejects conventionality and orthodox business theory to reward businesses embracing agility, reflex-style adaptability, innovation and creativity. This turbulence is, however, not a parenthesis or even a pattern, but the new reality in which each business must reinvent and redefine itself. This is a new reality of stakeholders that shift focus from the external to the internal, from the tangible to the intangible, and from fact to perception. This book presents research and paradigms that transcend classical theory in order to examine how business practice is positively affected by these conditions. Across a multitude of sectors and organisational types, scholars of different business specialisations set the theoretical foundations of contemporary thinking and present their practical implementations.
