Book excerpt: This textbook serves as a guide to real estate students and educators on the various property innovations and digital technologies that continue to shape the property industry. The advancement of PropTech in the last few decades has led to significant changes in real estate systems, operations, and practice, and this new textbook provides insight on the past, present, and future of PropTech innovations that have spread across the value chain of real estate through planning, development, management, finance, investment, operations, and transactions. The textbook approaches this subject from the real estate components, asset classes, and submarkets and links them to the associated innovations and digital technologies. It concludes by reviewing the role of education, innovation, skill development, and professionalism as major elements of the future of real estate operations and practice. This book’s unique contributions are in putting the “property” element at the forefront and then illustrating how technology can enhance the various areas of real estate; the focus on how the different innovations and technologies can enhance the economic, environmental, social, and physical efficiency of real estate; and its coverage of some non‐technological innovations like flexible working and more practical areas of real estate innovation such as skills, employability, creativity, and education. It contains 21 case studies and 29 case summaries, which can serve as practice exercises for students. This book will be useful to students in helping them build a knowledge base and understanding of innovation and digital technologies in the industry. Real estate educators can use the textbook as a guide to incorporate real estate innovation and digital technologies into their current teaching and also to develop their real estate curricula through PropTech‐related modules and courses where necessary. It will also be valuable to real estate researchers in search of the theoretical and conceptual linkages, as well as industry practitioners who seek insight into the current and future potential of digital technologies and their applications to real estate operations and practice.

Available in PDF, EPUB and Kindle. Book excerpt: Organised crime, corruption, and terrorism are considered to pose significant and unrelenting threats to the integrity, security, and stability of contemporary societies. Alongside traditional criminal enforcement responses, strategies focused on following the money trail of such crimes have become increasingly prevalent. These strategies include anti-money laundering measures to prevent ‘dirty money’ from infiltrating the legitimate economy, proceeds of crime powers to target the accumulated assets derived from crime, and counter-terrorist financing measures to prevent ‘clean’ money from being used for terrorist purposes. This collection brings together 17 emerging researchers in the fields of anti-money laundering, proceeds of crime, counter-terrorist financing and corruption to offer critical analyses of contemporary anti-assets strategies and state responses to a range of financial crimes. The chapters focus on innovative anti-financial crime measures and assemblages of governance that have become a feature of late modernity and on the ways in which individual nation states have responded to anti-money laundering and counter-terrorist financing requirements in light of their specific social, political, and economic contexts. This collection draws on perspectives from law, criminology, sociology, politics, and other disciplines. It adopts a much-needed international approach, focusing not only on expected jurisdictions, such as the United States and United Kingdom, but also on analysis from countries such as Qatar, Kuwait, Iran, and Nigeria. The authors stand out for their fresh and original research, which places them at the cutting edge of the subject. This book provides a comprehensive, insightful, and original study of an important and developing field for academics, students, practitioners, and policymakers in multiple jurisdictions.

Available in PDF, EPUB and Kindle. Book excerpt: Blockchain technologies and non-fungible tokens (NFTs) are increasingly being used in the structuring of real estate transactions. Proponents argue that these crypto innovations can revolutionize the way real property transfers operate by reducing or even eliminating what they see as the age-old inefficiencies that have historically characterized the real estate market. The setup is this: real estate is transferred to a special purpose business entity (typically an LLC), the ownership interest in which is embodied in an NFT that exists and can be transferred on a distributed ledger. The NFT, not the real estate, is then auctioned off to a buyer. Through ownership of the LLC holding company (by virtue of holding the NFT), the individual has the right to control possession of the realty. Through this method, so proponents argue, the need to conduct time-consuming and expensive title examinations is dispensed with, thereby leading to quicker closing periods and lower transaction costs. Moreover, crypto financiers facilitate the purchase with a loan to the buyer in exchange for taking a security interest in the NFT, rather than a mortgage over the real property. In this way, the crypto financier is ostensibly able to dispense with the rigamarole of the real property foreclosure system in preference for the more flexible and creditor-controlled procedures available under commercial law. In this Article, we show that this financing structure is rife with problems in both law and policy. Rather than simplifying the deal, the use of these crypto-centric mechanisms actually introduces new transaction costs. And indeed, the sum total of these new complexities and costs is likely greater than those that exist in the more prototypical mortgage deal. Moving beyond these critiques, this Article's main normative contribution is to explain how, when faced with the enforcement of a crypto financier's security rights in an NFT, the law should not take these structures at face value. Instead, we set forth an analytical framework for how courts should treat (including by recharacterizing) such enforcement actions so as to uphold strong public policies on ownership and the protection of real property debtors, despite efforts to circumvent them with crypto innovations.

Available in PDF, EPUB and Kindle. Book excerpt: Blockchains and cryptocurrencies, open banking, virtual assets, and artificial intelligence have become the buzzword of this decade. This book focuses on these ‘disruptive’ financial technologies that provide alternatives to the traditional financial services typically offered by regulated financial institutions. Financial technologies are characterized by the innovative ways in which they initiate, support or extend traditional financial services or offer alternative financial pathways and products. However, these financial technologies also pose money laundering and terrorist and proliferation financing as well as cyber security risks that require mitigation. This edited volume addresses a range of regulatory and enforcement challenges related to financial technology and financial crime. The book responds to the United Nations’ Sustainable Development Goals, in particular in relation to economic development, employment, national security, law enforcement and social well-being. Fostering responsible financial innovation promotes long-term economic growth, inclusion, and improved living standards. This book explores how to promote financial innovation while mitigating risks in a way that ensures financial prosperity and social inclusion.
