Book Synopsis The Development of the Criminal Law of Evidence in the Netherlands, France and Germany between 1750 and 1870 by : Ronnie Bloemberg
Download or read book The Development of the Criminal Law of Evidence in the Netherlands, France and Germany between 1750 and 1870 written by Ronnie Bloemberg and published by BRILL. This book was released on 2020-05-25 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book describes the development of the criminal law of evidence in the Netherlands, France and Germany between 1750 and 1870. In this period the development occurred that the so-called system of legal proofs was replaced with the (largely) free evaluation of the evidence. The system of legal proofs, which had functioned since the late middle ages, consisted of a set of strict evidentiary rules which predetermined when a judge could convict someone. In this book an explanation is given of the question why between 1750 and 1870 the strict evidentiary rules were replaced with the free evaluation of the evidence. The thesis of this research is that the reform was induced by a change in the underlying epistemological and political-constitutional discourses which together provided the ideas which inspired a significant reform of the criminal law of evidence.

Book Synopsis The Prison Experience by : Pieter Spierenburg
Download or read book The Prison Experience written by Pieter Spierenburg and published by Amsterdam University Press. This book was released on 2007-01-01 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: Though the prison is central to the penal system of most modern nations, many believe that imprisonment did not become a major judicial sanction until the nineteenth century. In this readable history, Pieter Spierenburg traces the evolution of the prison during the early modern period and illustrates the important role it has played as both disciplinary institution and penal option from the late sixteenth century onward. Placing particular emphasis on the prisons of the Netherlands, Germany, and France, The Prison Experience examines not only the long-term nature of prisons and the historical conceptions of their prisoners but also looks at the daily lives of inmates—supplementing our understanding of social change and day-to-day life in early modern Europe.

Book Synopsis From Sin to Insanity by : Jeffrey Watt
Download or read book From Sin to Insanity written by Jeffrey Watt and published by Cornell University Press. This book was released on 2018-09-05 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the broadest treatment yet of suicide in Europe during the period 1500–1800, 11 authors combine elements of social, cultural, legal, and intellectual history to trace important changes in the ways Europeans experienced and understood voluntary death. Well into the seventeenth century, Europeans viewed suicide as a terrible crime and an unforgivable sin resulting from demonic temptation. By the late eighteenth century, however, suicide was rarely subject to judicial penalties, and society tended to blame self-inflicted death on insanity rather than on the devil. From Sin to Insanity shows that early modern Europe witnessed nothing less than the birth of modern suicide: increasing in frequency, self-inflicted death became decriminalized, secularized, and medicalized, viewed as a regrettable but not shameful result of reversals in fortune or physical or mental infirmity. The ten chapters focus on suicide cases and attitudes toward self-murder from the fifteenth to the early nineteenth centuries in geographical settings as diverse as Scandinavia and Hungary, France and Germany, England and Switzerland, Spain and the Netherlands.
Book Synopsis Becoming Delinquent: British and European Youth, 1650–1950 by : Pamela Cox
Download or read book Becoming Delinquent: British and European Youth, 1650–1950 written by Pamela Cox and published by Routledge. This book was released on 2017-11-30 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2002: Becoming Delinquent: British and European Youth, 1650-1950 provides a critical synthesis of the growing body of work on the history of British and European juvenile delinquency. It is unique in that it analyzes definitions of and responses to, disorderly youth across time (from the mid-seventeenth to the mid-twentieth centuries) and across space (covering developments across Western Europe). This comparative approach allows it to show how certain themes dominated European discourses of delinquency across this period, not least panics about urban culture, poor parenting, dangerous pleasures, family breakdown, national fitness and future social stability. It also shows how these various threats were countered by recurring strategies, most notably by repeated attempts to deter delinquency, to divide responsibility between the state, civil society and the family, and to find a "proper" balance between moral reform and physical punishment, between care and control.

Download or read book Law and Mental Health written by David N. Weisstub and published by Elsevier. This book was released on 2013-10-22 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law and Mental Health: International Perspectives, Volume 3 considers the jurisprudence and models of legislation concerning public mental health that suit the particular requirements of different cultural and geographical regions. This book is composed of five chapters and begins with the major accomplishment both for Dutch legal psychiatry and for the English language audience, followed by a survey of the civil dimensions of the forensic system. The next chapter tackles the primary variables in assessing terrorism, including the social, political, religious, and economic factors, which, coupled with highly complex variables of psychological predisposition, can give some guarded inroads with respect to the limits of the knowledge in predicting and reacting to terrorist incidents. These topics are followed by discussions on the techniques for assessment designed for the differentiated legal questions in criminal, civil, and juvenile and family law. A chapter focuses on the measured assessments of the parameters of the professional knowledge about the nature of dangerous behavior based on clinical and research investigation. The final chapter contains a precise summary of the research that is to be done on a spectrum of techniques for assessing malingering. Mental health workers, forensic experts, and policy makers will find this book invaluable.
