Available in PDF, EPUB and Kindle. Book excerpt: “Few people realize that in the area of law, Texas began its American journey far ahead of most of the rest of the country, far more enlightened on such subjects as women’s rights and the protection of debtors.” Thus James Haley begins this highly readable account of the Texas Supreme Court. The first book-length history of the Court published since 1917, it tells the story of the Texas Supreme Court from its origins in the Republic of Texas to the political and philosophical upheavals of the mid-1980s. Using a lively narrative style rather than a legalistic approach, Haley describes the twists and turns of an evolving judiciary both empowered and constrained by its dual ties to Spanish civil law and English common law. He focuses on the personalities and judicial philosophies of those who served on the Supreme Court, as well as on the interplay between the Court’s rulings and the state’s unique history in such areas as slavery, women’s rights, land and water rights, the rise of the railroad and oil and gas industries, Prohibition, civil rights, and consumer protection. The book is illustrated with more than fifty historical photos, many from the nineteenth and early twentieth centuries. It concludes with a detailed chronology of milestones in the Supreme Court’s history and a list, with appointment and election dates, of the more than 150 justices who have served on the Court since 1836.

Book excerpt: Examines and measures the extent to which statutory language affects judicial behavior. How does the language of legislative statutes affect judicial behavior? Scholars of the judiciary have rarely studied this question despite statutes being, theoretically, the primary opportunity for legislatures to ensure that those individuals who interpret the law will follow their preferences. In Checking the Courts, Kirk A. Randazzo and Richard W. Waterman offer a model that integrates ideological and legal factors through an empirical measure of statutory discretion. The model is tested across multiple judicial institutions, at both the federal and state levels, and reveals that judges are influenced by the levels of discretion afforded in the legislative statutes. In those cases where lawmakers have clear policy preferences, legislation encourages judges to strictly interpret the plain meaning of the law. Conversely, if policy preferences are unclear, legislation leaves open the possibility that judges will make decisions based on their own ideological policy preferences. Checking the Courts thus provides us with a better understanding of the dynamic interplay between law and ideology.

Available in PDF, EPUB and Kindle. Book excerpt: The laws that governed the institution of slavery in early Texas were enacted over a fifty-year period in which Texas moved through incarnations as a Spanish colony, a Mexican state, an independent republic, a part of the United States, and a Confederate state. This unusual legal heritage sets Texas apart from the other slave-holding states and provides a unique opportunity to examine how slave laws were enacted and upheld as political and legal structures changed. The Laws of Slavery in Texas makes that examination possible by combining seminal historical essays with excerpts from key legal documents from the slave period and tying them together with interpretive commentary by the foremost scholar on the subject, Randolph B. Campbell. Campbell's commentary focuses on an aspect of slave law that was particularly evident in the evolving legal system of early Texas: the dilemma that arose when human beings were treated as property. As Campbell points out, defining slaves as moveable property, or chattel, presented a serious difficulty to those who wrote and interpreted the law because, unlike any other form of property, slaves were sentient beings. They were held responsible for their crimes, and in numerous other ways statute and case law dealing with slavery recognized the humanness of the enslaved. Attempts to protect the property rights of slave owners led to increasingly restrictive laws—including laws concerning free blacks—that were difficult to uphold. The documents in this collection reveal both the roots of the dilemma and its inevitable outcome.

Book excerpt: Take a ringside seat at one of the most controversial trials in American history. The year is 1925, and the students of Dayton, Tennessee, are ready for a summer of fishing, swimming, and drinking root beer floats at Robinson’s Drugstore. But when their science teacher, J. T. Scopes, is arrested for having taught Darwin’s theory of evolution, it seems it won’t be an ordinary summer in Dayton. As Scopes’s trial proceeds, the small town pulses with energy and is faced with astonishing nationwide publicity. Suddenly surrounded by fascinating people and new ideas, Jimmy Lee, Pete, Marybeth, and Willy are thrilled. But amidst the excitement and circus-like atmosphere is a threatening sense of tension—not only in the courtroom, but among even the strongest of friends. ★ “The colorful facts [Bryant] retrieves, the personal story lines, and the deft rhythm of the narrative are more than enough invitation to readers to ponder the issues she raises.”—Publishers Weekly, Starred

Available in PDF, EPUB and Kindle. Book excerpt: An in-depth analysis of the workings and legacy of the Supreme Court led by Charles Evans Hughes. Charles Evans Hughes, a man who, it was said, "looks like God and talks like God," became chief justice in 1930, a year when more than 1,000 banks closed their doors. Today the Hughes Court is often remembered as a conservative bulwark against Franklin Roosevelt's New Deal. But that view, according to author Michael Parrish, is not accurate. In an era when Nazi Germany passed the Nuremberg Laws and extinguished freedom in much of Western Europe, the Hughes Court put the stamp of constitutional approval on New Deal entitlements, required state and local governments to bring their laws into conformity with the federal Bill of Rights, and took the first steps toward developing a more uniform code of criminal justice.
