Book excerpt: L'objet de la thèse est d'étudier l'histoire et les fondements méthodologiques de l'analyse économique du droit née sous l'impulsion d'auteurs rattachés à l'école de Chicago comme Becker, Coase, ou Posner. L'analyse économique du droit tente de fournir une explication économique de l'ensemble des objets juridiques sur le double fondement de la théorie de l'action rationnelle et du marché. La première partie revient sur les fondements de l'analyse économique du droit - le programme de recherche beckerien, la théorie coasienne et la théorie des droits de propriété - et plus spécifiquement sur les conséquences, pour l'économie du droit, du théorème de Coase. On montre comment le théorème impose de prendre en considération les coûts de transaction positifs et de concevoir les règles de comme d'authentiques modes de coordination des actions individuelles. Dans une seconde partie, la thèse étudie alors la théorie posnérienne. On montre d'abord comment la représentation posnérienne du droit se différencie d'autres théories économiques du droit comme la théorie hayékienne ou celle du Public Choice. La célèbre hypothèse que la common law peut coordonner efficacement les agents en mimant les résultat du marché est alors présentée. Pour défendre cette thèse, Posner adopte une théorie réaliste des normes de droit qui le conduit à renoncer partiellement à la méthode économique partagée les économistes de Chicago. L'éclatement du courant de l'analyse économique du droit au cours des années 1980 est alors réinterprété, non comme le fruit de critiques normatives, mais comme le résultat des déplacements analytiques et méthodologiques dont l'école de Chicago a été le théâtre.
