Available in PDF, EPUB and Kindle. Book excerpt: The modern effort to locate American liberties, it turns out, began in the mud at the bottom of Baltimore harbor. John Barron Jr. and John Craig sued the city for damages after Baltimore’s rebuilt drainage system diverted water and sediment into the harbor, preventing large ships from tying up at Barron and Craig’s wharf. By the time the case reached the U.S. Supreme Court in 1833, the issue had become whether the city’s actions constituted a taking of property by the state without just compensation, a violation of the Fifth Amendment to the U.S. Constitution. The high court’s decision in Barron v. Baltimore marked a critical step in the rapid evolution of law and constitutional rights during the first half of the nineteenth century. Diminishing the Bill of Rights examines the backstory and context of this decision as a turning point in the development of our current conception of individual rights. Since the colonial period, Americans had viewed their rights as springing from multiple sources, including the common law, natural right, and English legal tradition. Despite this rich heritage and a prohibition grounded in the Magna Carta against uncompensated state takings of property, the Court ruled against Barron’s claim. The Bill of Rights, Chief Justice John Marshall declared in his opinion for the majority, restrained only the federal government, not the states. The Fifth Amendment, accordingly, did not apply to Maryland or any of the cities it chartered. In explaining how the Court came to reject a multisourced view of human liberties—a position seemingly inconsistent with its previous decisions—William Davenport Mercer helps explain why we now envision the Constitution as essential to guaranteeing our rights. Marshall’s view of rights in Barron, Mercer argues, helped him navigate the Court through the precarious political currents of the time. While the chief justice may have effected a shrewd political maneuver, the decision helped hasten a reconceptualization of rights as located in documents. Its legacy, as Mercer’s work makes clear, is among the Jacksonian era’s significant democratic reforms and marks the emergence of a distinctly American constitutionalism.

Available in PDF, EPUB and Kindle. Book excerpt: With its dignified courthouse set among shade trees and lawns dotted with monuments to prominent citizens and fallen veterans, the courthouse square remains the civic center in a majority of the county seats of Texas. Yet the squares themselves vary in form and layout, reflecting the different town-planning traditions that settlers brought from Europe, Mexico, and the United States. In fact, one way to trace settlement patterns and ethnic dispersion in Texas is by mapping the different types of courthouse squares. This book offers the first complete inventory of Texas courthouse squares, drawn from extensive archival research and site visits to 139 of the 254 county seats. Robert Veselka classifies every existing plan by type and origin, including patterns and variants not previously identified. He also explores the social and symbolic functions of these plans as he discusses the historical and modern uses of the squares. He draws interesting new conclusions about why the courthouse square remains the hub of commercial and civic activity in the smaller county seats, when it has lost its prominence in others.

Book excerpt: With essays on U.S. history ranging from the American Revolution to the dawn of the twenty-first century, Contested Democracy illuminates struggles waged over freedom and citizenship throughout the American past. Guided by a commitment to democratic citizenship and responsible scholarship, the contributors to this volume insist that rigorous engagement with history is essential to a vital democracy, particularly amid the current erosion of human rights and civil liberties within the United States and abroad. Emphasizing the contradictory ways in which freedom has developed within the United States and in the exercise of American power abroad, these essays probe challenges to American democracy through conflicts shaped by race, slavery, gender, citizenship, political economy, immigration, law, empire, and the idea of the nation state. In this volume, writers demonstrate how opposition to the expansion of democracy has shaped the American tradition as much as movements for social and political change. By foregrounding those who have been marginalized in U.S society as well as the powerful, these historians and scholars argue for an alternative vision of American freedom that confronts the limitations, failings, and contradictions of U.S. power. Their work provides crucial insight into the role of the United States in this latest age of American empire and the importance of different and oppositional visions of American democracy and freedom. At a time of intense disillusionment with U.S. politics and of increasing awareness of the costs of empire, these contributors argue that responsible historical scholarship can challenge the blatant manipulation of discourses on freedom. They call for careful and conscientious scholarship not only to illuminate contemporary problems but also to act as a bulwark against mythmaking in the service of cynical political ends.

Available in PDF, EPUB and Kindle. Book excerpt: The extraordinary story of one couple’s determination to free themselves and their children from slavery and make a new life in Canada Prior to abolition in 1865, as many as 40,000 men, women, and children made the perilous trip north from enslavement in the United States to freedom in Canada. Many were aided by networks that came to be known as the Underground Railroad. And the stories that emerge from the past about these journeys are truly remarkable. In A Shadow on the Household, Bryan Prince, a descendant of slaves, brings to life the heart-wrenching story of the Weems family and their struggle to liberate themselves from slavery. John Weems, a man who purchased his own freedom, paid the owner of his enslaved wife and eight children an annual fee to keep them together at one plantation. But when that owner died, the Weemses were cruelly separated and scattered throughout the South. Heartbroken and desperate, John resolved to raise the money to buy his family’s freedom and reunite them. Mining newspapers, private letters, diaries, estate records, marriage registries, and abolitionist papers for details of a story cloaked in secrecy, Bryan Prince has rescued the Weems family and their plight from historical oblivion. An unforgettable story of love and persistence, played out in four countries (the United States, Canada, Jamaica, and the United Kingdom) against the backdrop of the publication of Uncle Tom’s Cabin, a growing abolitionist movement, and the heroic efforts of the Underground Railroad, the Weems family saga must be read to be believed.
