The threat of treason and rebellion pervaded the British Atlantic in the 17th and 18th centuries; Britain's control of its territories was continually threatened by rebellion and war, both at home and in North America. Book excerpt: The growth in England and Britain’s merchant marine from the medieval period onwards meant that an increasing number of criminal offences were committed on or against the country’s vessels while they were at sea. Between 1536 and 1834, such crimes were determined at the Admiralty Sessions if brought to trial. This was a special part of the wider Admiralty Court, which, unlike the other forums in that tribunal, used English common law procedure rather than Roman civil law to try its cases. To a modest extent, this produced a ‘hybrid’ court, dominated by the common law but influenced by aspects of Europe’s other major legal tradition. The Admiralty Sessions also had their own (highly singular) regime for executing convicts, used the Marshalsea prison to hold their suspects and displayed the Admiralty Court’s ceremonial silver oar at their hearings and hangings. During the near three centuries of its existence, the Admiralty Sessions faced enormous legal and logistical problems. The crimes they tried might occur thousands of miles and months of sailing time away from England. Assembling evidence that would ‘stand up’ in front of a jury was a constant challenge, not least because of the peripatetic lives of the seafarers who provided most of their witnesses. The forum’s relationship with terrestrial criminal courts in England was often difficult and the demarcation between their respective jurisdictions was complicated and subject to change. Despite all of these problems, the court experienced significant successes, as well as notable failures, in its battle to deal with a litany of serious maritime crimes, ranging from piracy to murder at sea. It also spawned a series of Vice-Admiralty Courts in English and British colonies around the world. This book documents the origins, development and abolition of the Admiralty Sessions. It discusses all of the major crimes that were determined by the forum, and examines some of the more arcane and unusual offences that ended up there. Some of the unusual challenges presented by the maritime environment, whether the impossibility of preserving dead bodies at sea, the extensive power given to captains to physically punish sailors, the difficulty of securing suspects in small vessels, or the often gruesome problems occasioned by the marginal legal status of slaves, are also considered in detail.

Nothing but the creation of the large standing navies of the present age crippled them; nothing less than the conquest of their too convenient coasts could have thoroughly suppressed them. During those three centuries they levied blackmail upon all who had any trading interest in the Mediterranean. The Venetians, Genoese, Pisans in older days; the English, French, Dutch, Danish, Swedish, and American Governments in modern times, purchased security by the payment of a regular tribute, or by the periodical presentation of costly gifts. The penalty of resistance was too well known to need exemplification; thousands of Christian slaves in the bagnios at Algiers bore witness to the consequences of an independent policy. So long as the nations of Europe continued to quarrel among themselves, instead of presenting a united line of battle to the enemy, such humiliations had to be endured; so long as a Corsair raid upon Spain suited the policy of France; so long as the Dutch, in their jealousy of other states, could declare that Algiers was necessary to them; there was no chance of the plague subsiding; and it was not till the close of the great Napoleonic wars that the Powers agreed, at the Congress of Aix-la-Chapelle in 1818, to act together, and do away with the scourge of Christendom. The filibustering expedition of Jason and the loot of the Golden Fleece is an early instance, and the Greeks at all times have distinguished themselves by acting up to Jason's example by sea and land. The Moslems, however, were some time in accustoming themselves to the perils of the deep. At first they marvelled greatly at "those that go down to the sea in ships, and have their business in great waters," but they did not hasten to follow them. In the early days of the conquest of Egypt the Khalif 'Omar wrote to his general and asked him what the sea was like, to which 'Amr made answer: "The Sea is a huge beast which silly folk ride like worms on logs;" whereupon, much distressed, the prudent Khalif gave orders that no Moslem should voyage on so unruly an element without his leave. But it soon became clear that if the Moslems were to hold their own with their neighbours (still more if they meant to hold their neighbours' own) they must learn how to navigate; and accordingly, in the first century of the Hijra, we find the Khalif 'Abd-el-Melik instructing his lieutenant in Africa to use Tunis as an arsenal and dockyard, and there to collect a fleet....

Book excerpt: This volume publishes for the first time, the journal kept by John Looker (?1670—1715) recording his service as ship’s surgeon on the Blackham Galley, a London-built merchantman on its second trading voyage to the Levant, between December 1696 and March 1698. Preserved in the Caird Library of the National Maritime Museum, Looker’s ‘Journall’ describes his experiences on the voyage from the point at which he joined the ship at Gravesend, to March 1698, when the journal breaks off abruptly in mid-sentence when the ship was off the Kentish ‘Narrows’. John Looker was a Londoner, brought up in one of the parishes to the east of the City which furnished large numbers of mariners to the English sea-borne trades. He served an apprenticeship to a London barber-surgeon, and became a Freeman of the Company of Barber-Surgeons. His fifteen months of service on board the Blackham Galley appears to have been his only employment at sea, but his ready knowledge of maritime ways and language, which are apparent from the first pages of his ‘Journall’, make it more than likely that he came from a seafaring family. Subsequent to his voyage, he married, raised a family, practiced in London as a surgeon, and acquired land in East Anglia. He died at Bath in 1715. Looker’s ‘Journall’ divides naturally into three parts. The Blackham Galley’s outward and homeward voyages were largely without incident. The time spent by the Blackham Galley in Turkish waters, covers its voyage from Smyrna to Constantinople, where the ship stayed for a month, and then returned to Smyrna. Captain Newnam’s ill-advised and disastrous attempt at privateering in Ottoman waters on the return journey to Smyrna, led to the detention of his vessel at Smyrna under a double interdict from the English ambassador at the Porte and from the Ottoman authorities. Looker’s account of the Blackham Galley’s enforced stay in Smyrna furnishes a vigorous and detailed account of social life in the international merchant community, as well as portside life seen ‘from below’, with its taverns and prostitutes, and the activities and frequent ‘debauches’ of an increasingly bored and fractious crew. Looker’s record also provides interesting detail of his professional approach to treatment of the illnesses, accidents and occasional deaths of members of the company of his own and other ships anchored off Smyrna.

The study charts the course of victims' lives from capture to eventual liberation, death in Barbary, or, for a lucky few, escape. After sketching the outlines of Barbary's government and society, and the world of the corsairs, it describes the trauma of the slave-market, the lives of galley-slaves and labourers, and the fate of female captives. Most captives clung on to their Christian faith, but a significant minority apostatized and accepted Islam. For them, and for Britons who joined the corsairs voluntarily, identity became fluid and multi-layered. Bernard Capp also explores in depth how ransoms were raised by private and public initiatives, and how redemptions were organised by merchants, consuls, and other intermediaries. With most families too poor to raise any ransom, the state came under intense pressure to intervene. From the mid-seventeenth century, the navy played a significant role in 'gunboat diplomacy' that eventually helped end the corsair threat. The Barbary corsairs posed a challenge to most European powers, and the study places the British story within the wider context of Mediterranean slavery, which saw Moors and Christians as both captors and captives.
