Download or read book EU Employment Law written by Jeff Kenner and published by Bloomsbury Publishing. This book was released on 2002-12-23 with total page 648 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book traces the evolution of European Union employment law and social policy from its essentially economic origins in the Treaty of Rome through to the emerging themes post-Amsterdam: co-ordination of national employment policies, modernisation of social laws and combating discrimination. Each stage of development of Community employment law and social policy is analysed in depth to give a sense of perspective to this fast changing field. As the European Union seeks to meet the challenges of globalisation the need to develop social policy as a productive factor has come to the fore. The author explains how the social, economic and employment imperatives of European integration have always been intertwined and how the emergence of Community employment law from its hitherto twilight existence is best understood through an examination of consistent strands of policy development.

Book Synopsis Sovereignty in Post-Sovereign Society by : Jiří Přibáň
Download or read book Sovereignty in Post-Sovereign Society written by Jiří Přibáň and published by Routledge. This book was released on 2016-03-09 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sovereignty marks the boundary between politics and law. Highlighting the legal context of politics and the political context of law, it thus contributes to the internal dynamics of both political and legal systems. This book comprehends the persistence of sovereignty as a political and juridical concept in the post-sovereign social condition. The tension and paradoxical relationship between the semantics and structures of sovereignty and post-sovereignty are addressed by using the conceptual framework of the autopoietic social systems theory. Using a number of contemporary European examples, developments and paradoxes, the author examines topics of immense interest and importance relating to the concept of sovereignty in a globalising world. The study argues that the modern question of sovereignty permanently oscillating between de iure authority and de facto power cannot be discarded by theories of supranational and transnational globalized law and politics. Criticising quasi-theological conceptualizations of political sovereignty and its juridical form, the study reformulates the concept of sovereignty and its persistence as part of the self-referential communication of the systems of positive law and politics. The book will be of considerable interest to academics and researchers in political, legal and social theory and philosophy.
Book Synopsis Transparency and Proportionality in the Schengen Information System and Border Control Co-Operation by : Stephen Kabera Karanja
Download or read book Transparency and Proportionality in the Schengen Information System and Border Control Co-Operation written by Stephen Kabera Karanja and published by Martinus Nijhoff Publishers. This book was released on 2008 with total page 491 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume offers an evaluation of the Schengen Information System and border control co-operation from a transparency and proportionality perspective. It also incorporates a legal descriptive analysis of the co-operation in order to accommodate the changes and developments that occurred during the writing period. The transparency and proportionality perspectives are developed from human rights and data protection criteria. Transparency is understood as knowledge and accessibility to legal information as well as openness and accountability. On the other hand, proportionality is a requirement for guidance, balance and justification as well as a need to avoid excessiveness and arbitrariness in border control work. The final findings reveal that the Schengen co-operation suffers from a deficiency of transparency and proportionality. Consequently, measures are proposed to augment the deficiency. Even as this study was reaching its conclusion, fundamental legislative changes, closely similar to some of the arguments and recommendations projected in this study, took place. The efficacy of these changes is yet to be discerned.
Book Synopsis Searching for Leadership by : Patrice Dutil
Download or read book Searching for Leadership written by Patrice Dutil and published by University of Toronto Press. This book was released on 2008-08-02 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although the subject of "leadership" is a hot topic, it has never attracted much attention in the public sector. Searching for Leadership is the first book to examine the evolving role and leadership of the highest-ranking public servant in Ottawa or in any of Canada's Provinces and Territories, the Secretary to Cabinet, or the "Clerk." Arguing that the leadership role of the Secretary to Cabinet must be appreciated and understood in light of modern management practices and the centralization of administrative practices, the contributors to this volume present a mixture of approaches to the position: literature reviews, structural approaches, and biographical case studies of influential Secretaries to the Cabinet. Analyzing the role of Secretaries to the Cabinet in Ottawa as well as in Alberta, Saskatchewan, Quebec, and Ontario, the contributors detail the roles, key functions and impact of these highly influential public servants, highlighting the ways in which the leadership skills of Secretaries to the Cabinet have changed and responded to change. An important contribution to understanding Canadian governance and public management, Searching for Leadership is essential reading for scholars and students in political science, history, public administration and management, as well as public servants.

Available in PDF, EPUB and Kindle. Book excerpt: In The Black Hole of Public Administration experienced public servant Ruth Hubbard and public administration iconoclast Gilles Paquet sound a wake-up call to the federal public service. They lament the lack of "serious play" going on in Canada's public administration today and map some possible escape plans. They look to a more participatory governance model -"open source" governing or "small g" governance - as a way to liberate our public service from antiquated styles and systems of governing. --

Book Synopsis The Rights of Immigrant Workers in the European Union by : Joanna Apap
Download or read book The Rights of Immigrant Workers in the European Union written by Joanna Apap and published by BRILL. This book was released on 2002-09-01 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is one of the very few studies that evaluates the evolving policies towards third country nationals residing and working in the European Union (EU). Other studies have analysed the existing legal framework of citizenship and migrants' rights in the EU and the flow of migrants into the Community. However, much less comparative research has been carried out about the actual position and the practice of migrants' rights in the receiving countries, in the context of an ever integrating EU and the removal of internal borders. The focus of this book is on the consequences of the increasing number of Maghrebin workers residing in Italy and Spain - both for EU policy and with respect to these two countries as relatively new receiving states. The book examines: What public policy implications does the labour immigration from the Maghreb Countries have for the EU as a supranational Community rather than for the Member states individually? To what extent can citizenship rights be extended to third country nationals legally residing in a European Union to make their status as close as possible to that of European citizens?
Book Synopsis Project and Policy Evaluation in Transport by : Liana Giorgi
Download or read book Project and Policy Evaluation in Transport written by Liana Giorgi and published by Routledge. This book was released on 2017-11-22 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2002: There is a multitude of assessment methods available for analyzing and reporting on the impacts of policies, all with different underlying assumptions and a wide range of criteria. Since the 1950s, much research has gone into creating guidelines for policy analysis, yet only a small percentage of evaluation has been carried out on transport policy - and none by political scientists or social policy specialists. The editors of this volume recognize that European integration has seen a drive to bring policy evaluation on to the transport agenda and has increased demands for ’strategic assessments’. It has become apparent that to gain a fuller understanding of the success of a transport programme, a much more complex combination of analytical methods must be used, and a set of guidelines specifically for the field of transport must be developed. This book achieves this by bringing together a multidisciplinary team of analysts from throughout the EU to discuss in a much broader way the various types of assessment methods and how they can best be used to evaluate transport programmes and systems, both individually and in combination.
Book Synopsis Digital Borders and Real Rights by : Evelien Renate Brouwer
Download or read book Digital Borders and Real Rights written by Evelien Renate Brouwer and published by BRILL. This book was released on 2008 with total page 597 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since its launch in 1995, the majority of personal data held in the Schengen Information System (SIS) concerns third-country nationals to be refused entry to the Schengen territory. This study reveals why the use of the SIS (and the second generation SIS or SIS II) entails a risk to the protection of human rights such as the right to privacy and the right to data protection, but also the freedom of movement of persons and the principle of non-discrimination. This study describes the implementation of the SIS in respectively France, Germany, and the Netherlands and the available legal remedies in both data protection and immigration law. On the basis of three general principles of European law, minimum standards are developed for effective remedies for individuals registered in the SIS, but also other databases such as Eurodac or the Visa Information System.

Book Synopsis Institutional and Policy Dynamics of Eu Migration Law by : Georgia Papagianni
Download or read book Institutional and Policy Dynamics of Eu Migration Law written by Georgia Papagianni and published by Martinus Nijhoff Publishers. This book was released on 2006 with total page 420 pages. Available in PDF, EPUB and Kindle. Book excerpt: The main objective of this book is to present the on-going process of European integration via a comprehensive analysis of the institutional dynamics of, and politics linked with, the emerging migration law and policy of the European Union. More specifically, it presents the historical evolution, the main institutional legislative and policy steps, the position of, and interactions among, the different actors, and the factors impeding the formation of a common policy at EU level. On this basis a critical analysis is provided of the main institutional problems, the current policy framework, the overarching rationale as well as of the content and quality of the nascent EU migration law. The book is divided into three parts. The first two parts provide a comprehensive study of the institutional framework and the substantive EC/EU law respectively. The third and final part provides a more general analysis of the policy-making process. Since the major achievements in the field of migration are recent, the book focuses to a great extent on the post-Amsterdam era. However, for reasons of coherence and in order to better evaluate recent developments, a concise overview of the origins of this policy is provided. Moreover, special emphasis is placed on the Schengen acquis, since its mark on European affairs has been and remains pronounced. Overall the attempt has been to provide an account, which is up to date with extensive historical references and combines both an academic and practical perspective to the legal and political issues involved. The approach based on the above elements will contribute to a new understanding of the main aspects of EU migration law and its policy ramifications andwill be of use to both academics and practitioners alike.
Book Synopsis Understanding State Aid Policy in the European Community by : Phedon Nicolaides
Download or read book Understanding State Aid Policy in the European Community written by Phedon Nicolaides and published by BRILL. This book was released on 2023-12-11 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why do the Member States of the European Union still grant aid and is that aid compatible with the objective of integration which should result in a better allocation of resources? The main purpose of this book is to explain the principles and methods of EC state aid policy in a manner which is both accessible and useful to practitioners and policy makers, by bringing together contributions from officials (both Community and national), industry representatives, and academics. In particular, it examines both theory on the role and objective of public assistance and current practice controlling such assistance. It addresses the issue of state aid from economic, legal and administrative perspectives and offers detailed information on current practice through case studies. It also considers likely future developments in the Community framework of state aid control. Finally, this book identifies major weaknesses in the present system of state aid rules, and paves the way for a proper economic analysis of the effects of forty years of state aid policy in the European Community.
