Book excerpt: In this report we consider the effects on the criminal justice system which have arisen following the introduction of the criminal courts charge in April 2015. Given concerns expressed specifically about the charge in written evidence to our wider inquiry into a range of courts and tribunals fees and charges, we decided to produce an early and separate report on the charge. We acknowledge that so soon after the introduction of the charge there is a dearth of robust statistical evidence about its impact, but we consider that there is sufficient anecdotal and other evidence to enable conclusions to be drawn. We explain in this report the background to the introduction of the criminal courts charge and the issues of principle concerning the charge. We also examine the consequences arising from the mandatory nature of the charge: courts have no option but to impose it, and to impose it at a fixed amount depending on where the case is heard and whether the defendant has pleaded guilty or not guilty, on those convicted of a criminal offence.

Book excerpt: The need for assurance is never more acute than in times of turbulence and uncertainty. The events following the financial market crisis demonstrate the catastrophic consequence of risk taking that exceeds the board’s appetite, and of not joining up risk intelligence for sound decision making. Boards and senior management alike consistently seek the ’one truth’ about risk exposures and strength of controls but are continuing to grapple with the challenge. Much has been written about assurance and the governance of risks, but mainly by those who provide it - such as internal auditors, accountants and information security technologists - for the purpose of advancing their professional practices. Less is written for or by those in governance who need assurance for the effective discharge of their responsibilities. Regulations do not usually go beyond acknowledging its importance and rely on those in the boardroom to get it right. Studies have consistently shown the link between weak corporate governance and corporate failures. The lack of reliable assurance has often been a factor. Assurance, as an integral part of corporate governance, cannot be taken for granted. It requires conscious action across the organisation. It is time to rethink assurance beyond its usual functional boundaries, to focus on what matters to the business and how discussions in the board room can be better supported by more joined up assurance. This book provides practical guidance for those who need that support as well as those who deliver assurance.

Book excerpt: This is the final report of three regional consultations for Asia, Near East and North Africa, and Latin America held virtually between September 2021 and January 2022. The objective of the consultations was to deliberate on a draft guidance “Advancing end-to-end traceability along capture fisheries and aquaculture value chains”. The consultations confirmed the relevance and comprehensiveness of the proposed critical tracking events (CTEs) and key data elements (KDEs) in aquaculture and capture fisheries. They also highlighted that due consideration should be paid to small-scale producers, while recognizing equivalency of data and flexibility in data needs, particularly for developing countries.

Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the interpretation of environmental offences contained in the waste, contaminated land, and habitats' protection regimes. It concludes that the current purposive approach to interpretation has produced an unacceptable degree of uncertainty. Such uncertainty threatens compliance with rule of law values, inhibits predictability, and therefore produces a scenario which is unacceptable to the wider legal and business community. The author proposes that a primarily linguistic approach to interpretation of the relevant rules should be adopted. In so doing, the book analyses the appropriate judicial role in an area of high levels of scientific and administrative complexity. The book provides a framework for interpretation of these offences. The key elements that ought to be included in this framework-the language of the provision, the harm tackled as drafted, regulatory context, explanatory notes and preamble, and finally, purpose in a broader sense-are considered in this book. Through this framework, a solution to the certainty problem is provided.

Available in PDF, EPUB and Kindle. Book excerpt: Business and human rights has emerged as a distinct field within the corporate governance movement. The endorsement by the United Nations Human Rights Council of a new set of Guiding Principles for Business and Human Rights in 2011 reinforces the State’s duty to protect against human rights abuses by third parties, including business; the corporate responsibility to respect human rights; and greater access by victims to effective remedy, both judicial and non-judicial. This book draws on the UN Guiding Principles and recent national plans of action, to provide an overview of relevant developments within the ASEAN region. Bridging theory and practice, the editors have positioned this book at the intersection of human rights risk and its regulation. Chapter authors discuss the implications of key case-studies undertaken across the region and various sectors, with a particular focus on extractive industries, the environment, and infrastructure projects. Topics covered include: due diligence and the role of audits; businesses’ responsibilities to women and children; and the mitigation of human rights risks in the region's emerging markets. The book sheds light on how stakeholders currently approach business and human rights, and explores how the role of ASEAN States, and that of the institution itself, may be strengthened. In doing so, the book identifies critical challenges and opportunities that lie ahead for the region in relation to business and human rights. This book will be of excellent use and interest to scholars, practitioners and students of human rights, business and company law, international law, and corporate governance.
