Download or read book Development of the Constitutions in China and the Visegrad States written by Lu Da and published by Springer Nature. This book was released on 2021-08-30 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with the development of constitutional law in China and Visegrad states by employing a comparative perspective. It is the first time that the researcher compared the constitutional development in the China and the Visegrad states. It offers a few glimpses of development of constitution in the (former) socialist states to readers who are interested in the constitutional law or China–V4 relations. With the increased cooperation between China and V4 countries, this book gives the undergraduates in the university to think about the BRI and 17+1 network from a Chinese perspective. Last, compared to the previous works which mainly focus on North America and/or Western Europe, this book provides a new angle on comparative constitutional law.
Book Synopsis Expanding Intellectual Property by : Hannes Siegrist
Download or read book Expanding Intellectual Property written by Hannes Siegrist and published by Central European University Press. This book was released on 2017-06-15 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book deals with the expansion and institutionalization of intellectual property norms in the twentieth century, with a European focus. Its thirteen chapters revolve around the transfer, adaptation and the ambivalence of legal transplants in the interface between national and international projects, trends and contexts. The first part discusses the institutionalization of copyright and patent law in the frame- work of the bigger political and economic projects of the twentieth century. The second and third parts of the collection review relevant processes in the communist regimes and the post-communist societies, respectively. The essays point at processes of enculturation, trans-nationalization and universalization of norms, as well as practices of incorporation and resistance. The contributors lay a particular emphasis on the role and activity of social actors in the establishment and validation of intellectual property norms and regimes, from the function of experts and creation of expert cultures to the compelling power of popular street protests.

Book Synopsis Constitutional Law and Federations by : Iacovos Kareklas
Download or read book Constitutional Law and Federations written by Iacovos Kareklas and published by Rowman & Littlefield. This book was released on 2021-10-18 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional Law and Federations provides a concise overview of the British occupation of Cyprus(1878-1959), the efforts of the Greek Cypriots for independence, and the structure and peculiarities of the current Cyprus Constitution. Federal states and the concept of federalism worldwide and, in every era, have come into being because of important political and security reasons dictating or necessitating the creation of such governmental organizations. The bi-zonal federation envisaged for Cyprus, in the Accords of 1977 and 1979 is not in compliance with these prerequisites. According to objective legal norms, bi-communal and bi-zonal federation flagrantly violates international law and is incompatible with the notion of human rights with regard to Cyprus. A federation modelled on the United States of America federal Constitution could, indeed, provide an ideal framework for settling the Cyprus problem and safeguarding the protection of basic human rights and constitutional freedoms for all sections of the population on the island. This book will be of interest to scholars and students of constitutional law, international law and international relations as well as diplomats, who deal not only with the Cyprus issue but also with related regional and international issues.

Book Synopsis Rethinking Human Rights for the New Millennium by : A. Fields
Download or read book Rethinking Human Rights for the New Millennium written by A. Fields and published by Springer. This book was released on 2003-01-17 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book invites people to think more deeply about human rights in an attempt to overcome many of the traditional arguments in the human rights literature. Belden Fields argues that human rights should be reconceptualized to combine philosophical, historical, and empirical-practical dimensions. The best way to understand human rights is not as a set of universal abstractions but rather as a set of past and ongoing social practices rooted in the claims and struggles of peoples against what they consider to be political, economic, or social domination. Fields aptly shows how a people's fight for recognition is often closely tied to rights claims and that these connections to identify can help bridge the gulf between universalistic and cultural relativistic arguments in the human rights debate.

Download or read book Bringing in the People written by Markku Suksi and published by BRILL. This book was released on 2024-02-26 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: The referendum is not a monolithic method of national decision making. There are a multitude of referendum forms which exist under varying constitutional conditions and operate in different ways. A global comparison shows that more than half the constitutions of the world provide for the referendum at a national level, but referendums are also carried out without explicit constitutional support. Two main forms of referendum can be observed, the mandatory constitutional referendum and the policy vote. This book argues that the referendum does not undermine representative decision making, but supplements it in various ways: the referendum is not diametrically opposed to representative government, and when properly designed and used, the institution of the referendum can enhance the legitimacy of a constitutional and political system. This book is the first comprehensive constitutional and comparative analysis of the referendum. It offers illuminating and intriguing reading for all those interested in national decision making.

Book Synopsis Insular Destinies by : Paschalis Kitromilides
Download or read book Insular Destinies written by Paschalis Kitromilides and published by Routledge. This book was released on 2019-11-15 with total page 217 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this collection, an eminent authority on the history of political thought and on the intellectual history of modern Hellenism employs his twin academic specializations in political science and in intellectual history to understand the intricacies of the historical experience of his native island. Writing in a perspective inspired by the work of Fernand Braudel, he attempts in a series of studies in cultural and social history to recover lost and overlooked aspects of the collective destinies of Cyprus and the Cypriot diaspora in the centuries of Ottoman rule, a period of critical significance for the survival of the people of the island. He then turns to a penetrating analysis of the politics of the Cyprus Question. The pertinent studies collected in this volume bear the imprint of the deep soul-searching by the younger generation of Cypriot scholars at the time of the tragedy of 1974 over what went so wrong that their country was exposed to foreign invasion, occupation and division. The hints at answers to these questions offered by the author’s interdisciplinary and critical treatment of the subject make this work an indispensable aid to anyone wishing to grasp the deeper antinomies and dilemmas immanent in the Cyprus Question.

The developments which have taken place under the Convention since the second edition was published have been numerous & comprehensive, & the Convention has gained a central position in the legal systems of many European countries. Three Protocols have been added to the Convention; the number of Parties to the Convention has grown from twenty-two to no less than thirty-six; & the case-law concerning the Convention has increased significantly. Like its predecessors, this third edition offers a full description of the present procedural practice & case-law of both the European Commission & the European Court of Human Rights, & is an indispensable guide. Protocol No. 11 to the Convention, which will enter into force by the end of 1998, will drastically change the supervisory system under the Convention, establishing one Court. This new Court will also perform the present functions of the Commission & it is expected that it will be guided by the Commission's procedures & working methods, & by its case-law concerning admissibility. This new edition will therefore remain relevant for the practice & case-law of the new Court for many years to come.
