Book excerpt: Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. Book excerpt: Excerpt from The Constitutional History of the United States, Vol. 1 of 3: 1765-1788 Compromise failed, but the contest continued; civil war followed and the American system of government, State and national, was reorganized. The supreme law, that is, the general plan of American government, was amended, and many causes of irritation, and the princi pal cause of contest, were removed. The vast change caused by this reorganization is narrated in the third volume. Its great theme is emancipation and the exten sion of the suffrage. Book excerpt: Excerpt from Principles of the Constitutional Law of the United States This volume is an abridgment of the author's larger treatise in two volumes, published in 1910 under the title The Constitutional Law of the United States. The aim has been to present the general principles of our constitutional jurisprudence in a form suitable for class-room use. In pursuance of this aim care has been taken to cite those cases which not only support the positions stated in the text but which Will best repay individual examination and study by the student. In particular the effort has been made to suggest, and in a measure to discuss, the unsettled questions of our Federal jurisprudence. The necessary limits of space have prevented in many instances an adequate presentation of the arguments supporting the doctrines stated, but, from a pedagogic point of view this may be a merit rather than a defect, for it will furnish opportunity for a presentation by the students of the court's reasoning as gained by a reading of the cases, and a criticism by the instructor of the reasoning as thus pre sented. Book excerpt: Excerpt from The Constitutional Law of the United States of America It is not necessary further to enlarge upon these pomts, for what I have said is sufficient to show why the first inquiries with regard to a translation of the treatise were not received by me with a feeling of unmixed satisfac tion. I not only could have dived deeper, and would have done so, if I had intended to write for Americans, but even if I had confined myself to a mere sketch, the perspective would have been somewhat different. Be sides, the treatise had to be written at a time when I could not go either to England or the United States. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of the American Constitution, Vol. 1: Its Origin and Development The American federal system is based upon the Consti tution of the United States. That instrument was adopted to make more perfect the union which, having had its beginning in the common allegiance of the colonies to the British Crown during the war for independence, was welded closer by the necessity for common action, and found its first constitutional expression in the Articles of Confedera tion. Nineteen articles of amendment have been added to the Constitution in the hundred and thirty-four years since its adoption. It is hoped that in the first three chapters of this book a clear picture is given of the making of the Constitution, of the nature of the federal system which was set up, and of the principles which underlie the amending power. The Constitution of the United States first of all estab lishes a national government, and sets off to it certain fields in which it shall be supreme, at the same time imposing upon it certain specific prohibitions and restrictions. It was, however, very far from the purpose of the framers of that instrument to do away with the separate States or to reduce them to mere administrative units. Yet the grants of powers to the national government did of necessity operate as limitations upon the previous sovereign powers of the States; and to these implied limitations were added others which are express. In the second part of this book, I have dealt with the national government in its executive, judicial, and legislative departments, discussing the powers which are granted to each of them, and the limitations which are placed upon their activities. In Part III are con sidered the restrictions placed upon the States, and the extent of the powers which may still be exercised by them. It is believed that this is a logical method of treatment, and it is hoped that it will help to make clear the division of powers between the national and state governments under our federal system. No attempt has been made to treat of the powers of the States under their individual constitutions. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Constitution of the United States, Vol. 1 of 2: Its History, Application and Construction The Constitution of the United States is one of the great written instruments of the world. Its adoption marked the most advanced progress along the line of representative government which had occurred in history, and its influence has surpassed that of any similar document. Concerning the formation of the Constitution there was long a prevalent misconception. It was not wholly an orig inal creation of those who framed-it. The Colonial State papers, 'the Resolves of Congress, the Articles of Confedera tion and the State Constitutions contained many excellent provisions which were inserted in the greater instrument, while precedents for other provisions were found in the British Constitution. In the manner of arrangement I have followed the divi sion of the Constitution into articles, sections and clauses instead of considering similar provisions together. No attempt has been made to discuss collateral issues, or to criticise the Constitution because it contains too much or too little. Although new problems relating to constitu tional government are demanding consideration, I feel that one may be excused from discussing them in a work which treats of the Constitution as it is. Book excerpt: Excerpt from Commentaries on the Constitution of the United States, Vol. 1 of 3: With a Preliminary Review of the Constitutional History of the Colonies and States, Before the Adoption of the Constitution Sir, I ask the favour of dedicating this work to you. I know not, to whom it could with so much propriety be dedicated, as to one, whose youth was engaged in the arduous enterprises of the Revolution; whose manhood assisted in framing and supporting the national Constitution; and whose maturer years have been devoted to the task of unfolding its powers, and illustrating its principles. When, indeed, I look back upon your judicial labours during a period of thirty-two years, it is difficult to suppress astonishment at their extent and variety, and at the exact learning, the profound reasoning, and the solid principles, which they every where display. Other Judges have attained an elevated reputation by similar labours in a single department of jurisprudence. But in one department, (it needs scarcely be said, that I allude to that of constitutional law, ) the common consent of your countrymen has admitted you to stand without a rival. Posterity will assuredly confirm by its deliberate award, what the present age has approved, as an act of undisputed justice. Your expositions of constitutional law enjoy a rare and extraordinary authority. They constitute a monument of fame far beyond the ordinary memorials of political and military glory. They are destined to enlighten, instruct, and convince future generations: and can scarcely perish but with the memory of the constitution itself. They are the victories of a mind accustomed to grapple with difficulties, capable of unfolding the most comprehensive truths with masculine simplicity, and severe logic, and prompt to dissipate the illusions of ingenious doubt, and subtle argument, and impassioned eloquence. Book excerpt: Excerpt from Handbook of American Constitutional Law The author has been profoundly interested in these matters, and has endeavored, in this edition of his book, to give them an exhaustive and critical consideration, citing all the best available authorities. He has also subjected the entire work to a thorough revision and added to it a very great number of the more recent decisions, supplementary. To those already included, bearing upon its various topics and principles. That the book may prove equally interesting to the students and prae titioners of the law, and that it may now enter upon a new and more widely extended career of usefulness, is his earnest hope, in which he is encouraged by the very gratifying measure of favor and applause with which this and his other contributions to the literature of the law have been received by the profession.
