Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this very useful analysis of constitutional law in Venezuela provides essential information on the country’s sources of constitutional law, its form of government, and its administrative structure. Lawyers who handle transnational matters will appreciate the clarifications of particular terminology and its application. Throughout the book, the treatment emphasizes the specific points at which constitutional law affects the interpretation of legal rules and procedure. Thorough coverage by a local expert fully describes the political system, the historical background, the role of treaties, legislation, jurisprudence, and administrative regulations. The discussion of the form and structure of government outlines its legal status, the jurisdiction and workings of the central state organs, the subdivisions of the state, its decentralized authorities, and concepts of citizenship. Special issues include the legal position of aliens, foreign relations, taxing and spending powers, emergency laws, the power of the military, and the constitutional relationship between church and state. Details are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for both practising and academic jurists. Lawyers representing parties with interests in Venezuela will welcome this guide, and academics and researchers will appreciate its value in the study of comparative constitutional law.

Available in PDF, EPUB and Kindle. Book excerpt: This collection brings together some of the most influential sociologists of law to confront the challenges of current transnational constitutionalism. It shows the constitution appearing in a new light: no longer as an essential factor of unity and stabilisation but as a potential defence of pluralism and innovation. The first part of the book is devoted to the analysis of the concept of constitution, highlighting the elements that can contribute from a socio-legal perspective, to clarifying the principle meanings attributed to the constitution. The study goes on to analyse some concrete aspects of the functioning of constitutions in contemporary society. In applying Luhmann’s General Systems Theory to a comparative analysis of the concept of constitution, the work contributes to a better understanding of this traditional concept in both its institutionalised and functional aspects. Defining the constitution’s contents and functions both at the conceptual level and by taking empirical issues of particular comparative interest into account, this study will be of importance to scholars and students of sociology of law, sociology of politics and comparative public law.

Available in PDF, EPUB and Kindle. Book excerpt: This collection provides an up-to-date analysis of key country approaches to Militant Democracy. Featuring contributions from some of the key people working in this area, including Mark Tushnet and Helen Irving, each chapter presents a stocktaking of the legal measures to protect the democracy against its enemies within. In addition to providing a description of the country's view of Militant Democracy and the current situation, it also examines the legal and political provisions to defend the democratic structure against attacks. The discussion also presents proposals for the development of the Militant Democracy principle or its alternatives in policy and legal practice. In the final chapter the editor compares the different arrangements and formulates a minimum consensus as to what measures are indispensable to protect a democracy. Highly topical, this book is a valuable resource for students, academics and policy-makers concerned with democratic principles.

Available in PDF, EPUB and Kindle. Book excerpt: The modern state, law, and constitution result from a legal canon that (re)produces the abyssal lines dividing the world that is validated from the world whose humanity and epistemological validity are denied. This book aims to contribute to a post-abyssal reflection on law and constitutionalism by considering the structural axes of power that are constitutive of modern law “capitalism, colonialism, and heteropatriarchy” alongside the legal plurality of the world. Is it possible to decolonize, decommodify, and depatriarchalize the constitution? The authors speak from multiple geographies, raise different questions, resort to differentiated theoretical approaches, and reveal varying levels of optimism about the possibilities of transforming constitutions. The readers are confronted with critical perspectives on the Eurocentric legal canon, as well as with the recognition of anti-capitalist, anti-colonial, and anti-patriarchal legal experiences. The horizon of this publication is the expansion of the possibilities of legal and political imagination.

Available in PDF, EPUB and Kindle. Book excerpt: This book delves into the conceptual changes produced by the Spanish constitutional debate held between 27 August and 9 December 1931. Taking place at the beginning of Spain’s Second Republic, those parliamentary deliberations brought about significant novelties in the political vocabulary. Concepts such as democracy, sovereignty, reform, revolution, and freedom, among others, were re-signified. This study investigates the conceptual contributions made by Spanish MPs in the course of the constitutional debate of 1931 by assuming, as a research approach, an interdisciplinary stance combining conceptual history, political theory, and parliamentary constitutional history. By doing so, it selects five determining issues: the pervasive discussion about two competing meanings of a democratic state; the rhetorical uses of reform and revolution; conceptual controversies about religious freedom; the disputed idea of property rights; and the functions of parliament and the president of the republic in a semi-presidential regime. The constitutional debate was largely inspired by interwar European constitutionalism which constituent representatives used to update the Spanish constitutional tradition. With that goal in mind, this book is aimed at undergraduate and graduate students and scholars working in the fields of conceptual history, political philosophy, parliamentary history, European political history, and European constitutionalism. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on critical approaches to the state and state theory in the Global South. In light of the reemergence of the post-colonial and peripheral state as a crucial institution and actor in the 21st century’s capitalist world-system, the book examines the nature, functions and development dynamics of the state in the periphery, as well as its constituting interests and struggles. Drawing on the works of Poulantzas and Gramsci, dependency and world-systems theory, as well as the regulation school and the German Ableitungsdebatte, stategraphy and critical realism, it analyzes the development of different theoretical perspectives on the state, elaborates on their theoretical, ontological and epistemological presuppositions, and illustrates their methodological, practical and ethical implications. The book is divided into three parts, the first of which provides an overview of recent global capitalist developments and challenges for state theory and lays the theoretical, ontological and hermeneutic foundation for studies of the state and statehood in the Global South. In turn, the second part introduces readers to different schools of state theory, including critical theory and materialism, as well as approaches derived from postcolonial, anthropological, and feminist thought. Lastly, the third part presents various empirical studies, highlighting concrete methodological and practical experiences of conducting critical state theory.

Available in PDF, EPUB and Kindle. Book excerpt: Focusing on the processes of political socialisation and democratisation that took place in Spain during the nineteenth and twentieth centuries, this book brings together specialists who propose the need to rethink the contemporary history of democracy in Spain to build a new narrative. To do so, the authors go down to the local level, where they are able to trace a political culture that forged the foundations of a process of political "modernization" much more complex than what conventional historiography has conveyed, even though it was not always transferred institutionally to the national level. The idea of a rural Spain that was backward, apolitical, violent and unprepared for democracy gives way to a more interesting history which, while recognising the peculiarities of the country and the important limitations to democracy, shows examples that could help build a new narrative closer those of other neighbouring countries. Aimed at contemporary historians interested in Spain and Europe, the book also addresses the debates faced by other social scientists on the concept of democracy. This dialogue between history, sociology and political science is particularly present in a special final chapter featuring a discussion of democracy and its application to Spanish history.
