Nesse quadro, os consórcios públicos podem ser considerados o estágio final do processo de cooperação, fornecendo os instrumentos para possibilitar a gestão e a prestação conjunta de serviços públicos. O trabalho busca analisar o desenvolvimento de tais ajustes no direito brasileiro, especialmente após as recentes mudanças operadas no texto constitucional e levadas adiante pela Lei n.ð 11.107/05 (Lei de Consórcios Públicos), que resultaram no advento de um novo modelo contratual, concretizado numa pessoa jurídica intergovernamental. Os métodos de estudo envolvem as tarefas de identificação das raízes históricas das formas de cooperação, investigação das atuais possibilidades dos consórcios e seus limites e, finalmente, detalhamento do funcionamento da gestão associada, incluindo a estrutura da pessoa interfederativa, seus poderes e regime jurídico. As conclusões apontam para a importância da utilização planejada dos consórcios públicos de modo a que se alcancem consideráveis ganhos econômicos e sociais, permitindo aos governos locais enfrentar problemas comuns que de outra maneira não seriam resolvidos, em matérias como saúde pública, educação e outros serviços públicos - e apenas serviços públicos, já que a legislação restringe.

É nesse contexto que as pessoas políticas se unem por meio da celebração de consórcios públicos e de convênios para a gestão associada de serviços públicos, conforme dispõe o art. 241 da Constituição. Esta obra aborda o regime jurídico dos convênios de maneira distinta, conforme sejam celebrados somente entre entes públicos, ou na hipótese de haver um particular em um dos polos da relação jurídica formalizada por meio do convênio. Ademais, o regime jurídico dos convênios deve ser analisado a partir da expressão "no que couber", prevista no art. 116 da Lei no 8.666/93, de modo que terão plena aplicabilidade todas as normas jurídicas incidentes sobre os contratos que sejam compatíveis com a natureza não lucrativa dos convênios. Concebe-se o convênio, portanto, como espécie de contrato administrativo, tendo por peculiaridade a inexistência de lucro para as partes. Assim, o livro tem como objetivo geral analisar criticamente o instituto dos convênios, tradicionalmente utilizado para se efetivar o federalismo de cooperação entre entes públicos. Para tanto, fez-se um estudo aprofundado de sua natureza jurídica e do regime jurídico aplicável aos convênios celebrados entre entes públicos e entre a Administração Pública e organizações privadas. Como objetivos específicos, demonstra possíveis diferenças, impostas pelo ordenamento jurídico, entre os convênios celebrados por entes da própria Administração Pública e aqueles em que há uma organização particular figurando como partícipe. Livro de referência para profissionais que trabalham com o controle da Administração Pública, em especial membros do Ministério Público, Tribunais de Contas, Judiciário, como também advogados e servidores públicos responsáveis pelos processos de celebração de convênios administrativos.
